发包方索赔风险评估研究

【摘要】 工程索赔管理是工程项目管理中的一个非常重要的部分,其实质是发包方和承包商对相互间风险承担的再分配,是工程实施过程中发生在合同双方之间的重要业务活动,在施工合同的履行过程中发挥重要的作用。据统计,施工索赔是导致发包方项目管理目标出现偏差的最主要原因之一。因此,发包方有必要对项目进行索赔管理,从而减少施工索赔的发生,保证项目的目标得以实现。索赔风险评估是发包方索赔风险管理的前提和基础。在项目进行前,对项目的索赔风险进行分析和评估,分析各种可能出现的索赔风险因素,预判主要风险因素的风险大小,为发包方决策和工程管理提供参考依据,进而减少索赔的发生,提高项目的投资效益。本文建立了工程项目索赔风险评估指标体系和评估模型:首先结合工程项目和发包方工程项目管理的特点,分析了可能导致项目索赔发生的风险因素,并结合相关学者的研究成果建立了索赔风险评估指标体系;其次,运用物元-层次分析方法,在确定各层次风险评估指标的权重的基础上,结合物元关联函数计算方法,计算出各层次索赔风险评估指标对于各评估等级的关联度值,确定工程项目索赔风险评估综合等级;最后,运用具体工程实例来验证该评估模型在发包方对索赔风险进行预测时的科学性和实用性。从而得出结论,即运用本文所构建的工程项目索赔风险评判模型对工程项目进行索赔风险评估,有利于提高发包方决策管理的正确性,同时也为发包方在项目实施过程中的索赔风险控制的侧重点提供依据,达到对索赔风险进行预测进而加大主动控制的目的,对发包方预防索赔,减少索赔损失具有重要意义。

【Abstract】 The engineering claim management plays an important role in engineering project management.The essence of engineering claim management is redistribution of risk between the contract and the contractor.During the implement of construction project, the engineering claim management is critical business between the contracting parties and plays an important role in performance of the contract.According to statistics, the construction claim is one of the main reason for the deviation of the project management target.Therefore, it is necessary to manage the claim for the party awarding contract, to reduce the happening of the construction claims; to ensure the project objectives can be achieved.Claim risk assessment is the premise and foundation of claim risk management for the party awarding contract.Before the project carried on, the claim risk of project should be analyzed and assessed.All kinds of claims risk reasons that are possible to occur should be considered and the risk size of main risk reason should be sentenced in advance, which will provide the reference for decision-making of contract award side and project management, reducing incidence of claims and improving the project’s investment returns.The evaluation index system and evaluation model of engineering project claims risk is built in this paper:firstly, associating with the characteristics of engineering project and the project management, the risk reasons which are possible to cause the project claim to occurred are analyzed.And, on the basis of predecessors’work, the claim risk assessment indicator system is established.Secondly, when the weights of claim risk indicators of each value are determined, the element-analytical hierarchy is adopted to calculate the degree of association value that claim risk of each layer are linked with each evaluation level by using the calculation method of correlation function.After that, using the concrete project example validate the evaluation model of scientific and practical when the party awarding contract predict the risk of claims.Thus concluded that using the project claims risk evaluation model which this paper built to assess claim risk will improve the accuracy of decision-making management of the party awarding contract, as well as for the party awarding contract provides the basis of the emphasis of the risk control when the project implementing, to predict the risk of claims and increase the active control.It is important to prevent and reduce loss claims for the party awarding contract.
