【摘要】 环渤海地区是我国三大旅游经济圈之一,旅游业发展势头强劲。近年来,区域旅游合作在整体经济中扮演越来越重要的角色,区域旅游一体化步伐不断加快。进一步通过旅游立法协调为区域旅游合作和发展创造优良的法律和制度环境,对规范和促进环渤海地区旅游业的发展意义重大,对其他区域的旅游合作与发展也有很好借鉴作用。本文从环渤海旅游立法协调这个切入点入手,研究探讨在现时条件下环渤海区域旅游业发展,如何从政策调整到立法调整,并进行立法的协调,从而,通过优化旅游产业法律制度环境,促进旅游产业发展。从环渤海旅游立法协调的背景来看,区域旅游立法协调之所以必需,主要是由于区域旅游经济一体化的发展的客观需要。立法协调要从旅游业一体化的实际出发,又要通过规范制度规则体系,促进一体化发展。从硬件上看,环渤海旅游一体化发展所具备的基础条件较好,包括规模巨大城市集群、不断增长居民收入水平、优质旅游资源和旅游产品、良好的可进入性。环渤海一体化发展进程比较曲折,也存在一些制约因素。考察环渤海旅游立法协调,必须要首先考察该区域旅游立法的宏观环境。在国家旅游基本法缺失的大环境下,环渤海各省旅游立法,大体经历了从无到有,从制订到修改的过程。总的看,环渤海各省、区、市旅游立法构建了较为健全的地方旅游立法体系,彰显了地方特色并出台促进旅游产业保障支持措施,突出了旅游规划和旅游资源开发、保护,明确了旅游者、管理者、经营者之间权利义务关系,加强了立法过程中公众参与和制度创新。环渤海区域旅游立法协调对区域旅游一体化发展有着重要意义。环渤海旅游立法协调是适应旅游业快速发展的需要,是旅游立法自身的要求,也是适应市场经济客观需要。旅游立法协调的内容,包括法的渊源的协调、旅游法律体系协调旅游法的内部结构协调。旅游立法过程中的立法协调,旅游法案起草阶段的立法协调,旅游法律审议阶段的立法协调,要逐步完善和扩大实施旅游立法公众参与制度。环渤海地区域法律冲突需要高度关注。环渤海旅游立法冲突主要包括环渤海立法冲突中立法权限的冲突和立法文件内容及效力的冲突,归纳士旅游立法冲突的原因,可以分为主观方面的原因和客观方面的原因。这些冲突损害了法制统一需要进行有效的立法协调。必须建立一个行之有效的环渤海旅游立法协调机制。促进区域一体化发展,国家不可能置身局外,国家需要适时制订区域发展基本法,并为旅游立法的协调确立基本的原则。旅游立法要避免盲目性,增强针对性,就要进行立法论证。论证之后,按照决策要求实施旅游立法决策。要建立一个统一的环渤海区域旅游协调机构,并切实发挥作用,要建立区域旅游立法协调机制,重视提高旅游立法技术,加强旅游立法监督。更多还原

【Abstract】 Around Bohai sea area is one of the three large tourism economic circles of China, and its tourism industry are strongly prosperous. In recent years, regional tourism cooperation are playing a more and more important role in the overall economy. As the regional tourism integration speeding up, to further create excellent legal and systematic environment for the cooperation and development of regional tourism cooperation by tourism legislative coordination and for the specification and promotion of the tourism industry around Bohai Sea area are becoming significant. It will also be an excellent model for the other regional cooperation.Take tourism legislative coordination around Bohai Sea as a starting point, the article studied the development of tourism industry around Bohai Sea area under present situation. How to transfer from policies adjustments to legislative adjustments, and how to act out legislative coordination and thus promote the development of tourism industry by optimizing the policy and system environment.Judging from the background of the tourism legislative coordination around Bohai Sea area, regional tourism legislation is necessary mainly for the development of regional tourism integration. On the one hand, Legislative coordination is to proceed from the reality of tourism integration. On the other hand, promote the development of integration by standardize the regulation system. Judging from the hardware aspect, tourism integration development around Bohai Sea area have excellent basic conditions, which including large scale urban clusters, increasingly rising civil income, qualified tourism resources and products, well accessibilities. The process of integration development around Bohai Sea area is also twists and there are still some constraints.To investigate tourism legislation, one must first investigate the macro tourism legislative environment around Bohai Sea area. In the basic environment where national tourism legislation are missing, the provinces around Bohai Sea area started the process of tourism legislation which generally experienced the period of from none to exist and from formulate to amend. See from the features of tourism legislation around Bohai Sea area, they have established a relatively sound local tourism legislative system, formulated the protection and support measures for the positioning of tourism industry, highlighted tourism planning and tourism resources development and protection, clear defined the relationships of rights and obligations among tourists, managers and operators, strengthened public participation and system innovation in the legislative process.Tourism legislation coordination around Bohai Sea area is of great significance to its integrated development of tourism industry. It is the need to adapt to the rapid development of tourism, the requirements of the tourism legislation itself and the objective needs of market economy. The contents of Tourism legislative coordination includes the coordination of the sources of laws, the tourism law system, the internal structure coordination of tourism law, and the legislative coordination of in the process of legislation, drafting stage and committee stage, tourism legislation hearing system should be gradually improved.Conflicts of Laws around Bohai Sea area is a matter need to keep clear focus. The conflicts are mainly the legislative competence and the content and effect. The reasons can be reduced to the objective aspect and subjective aspect. These conflicts impair the unity of legal system, effective legislative coordination must be done..To establish an effective tourism legislation coordination mechanism to promote the development of regional integration, the State cannot stay aloof from the affair. Thus, the article suggests basic law of the nation for regional development which will establish the basic principles for the coordination of tourism legislation. To avoid blindness and enhance targeting, tourism legislation need legislative argumentation followed by the implementation of tourism legislation decision. To establish a unified tourism coordination institute and function effectively, the paper proposed the establishment of regional tourism legislation mechanisms. and attach importance to tourism technology and strengthen the supervision of tourism legislation.更多还原
