【摘要】 本文主要以罗尔斯的《正义论》为研究对象,旨在梳理和探讨其中罗尔斯的程序正义论。罗尔斯在《正义论》中,有关程序正义最直接的内容,是将程序正义分为纯粹的程序正义、完善的程序正义、不完善的程序正义三类,程序正义的论述更多的是间接体现在以纯粹的程序正义为核心的程序正义的证明与运用过程中。本文以罗尔斯从对程序正义直接和间接论述的两个方面来分析罗尔斯的程序正义,并分析罗尔斯纯粹的程序正义设计以及所体现的程序本身的内在价值——程序正义。本文共分为三部分,第一部分：罗尔斯程序正义论形成的背景及渊源。为了更好的探讨罗尔斯程序正义论的内容,本部分从横纵两个纬度来说明罗尔斯程序正义论的形成。横向是罗尔斯提出程序正义的《正义论》产生的背景,包括罗尔斯正义思想形成的个人成长背景和罗尔斯所处社会的时代背景。纵向是罗尔斯程序正义论形成的历史渊源,包括英国的“自然正义”、美国的“正当法律程序”和欧洲大陆其他国家的程序正义观念三个方面。第二部分：罗尔斯程序正义论之分析。本部分主要系统的分析罗尔斯程序正义论的内容。以罗尔斯《正义论》到《政治自由主义》为主线,首先论述罗尔斯在《正义论》当中对程序正义的三种分类：纯粹的程序正义、完善的程序正义、不完善的程序正义,以及笔者对罗尔斯程序正义论之解读。其次论述罗尔斯在《政治自由主义》中对程序正义的修正,引入实体正义并提出重叠一致的概念。《正义论》中纯粹的程序正义是罗尔斯程序正义的核心,而罗尔斯的两个正义原则是《正义论》的核心和重点,是指导社会的基本结构建立的正义原则,“纯粹的程序正义是证成两个正义原则的渠道和方式”,接下来笔者将分析罗尔斯是如何通过设计纯粹的程序正义来论证两个正义原则是“迄今为止最好的正义原则”。最后笔者从价值的独立性、对人的尊重、普遍的结果认同三个方面来谈谈罗尔斯纯粹的程序正义所体现的程序正义价值。第三部分：罗尔斯程序正义论之评析。自罗尔斯发表《正义论》一书以来,有关程序正义的理论和学说不断出现,有对罗尔斯积极的回应,也有对罗尔斯强烈的批评和质疑。本部分首先论述罗尔斯程序正义论的理论意义,然后分析众多学者对罗尔斯程序正义论的质疑。罗尔斯对程序正义的论述不仅对英美法系产生了深远的影响,同时,也引领了大陆法系国家诸如法、德等国对程序正义问题的深入探讨,鉴于中国历来有重实体,轻程序的传统,最后笔者谈谈罗尔斯程序正义论对我国的几点借鉴意义。本文主要采用了历史分析、比较分析、法律解释等方法进行研究。更多还原

【Abstract】 This dissertation put Rawls "a Theory of Justice" as the mainly research object, and aims to sort out and explore Rawls’ theory of procedural justice.In"a Theory of Justice", Rawls directly made the typological division on the procedural justice, That was, perfect procedural justice, imperfect procedural justice and pure procedural justice. The procedural justice more indirectly reflects on pure procedural justice,which as the core of the procedural justice proof and application process.This dissertation focus on procedural justice analysis of Rawls’ theory of procedural justice from two aspects,including direct and indirect two aspects. This dissertation also analyzes Rawls pure procedural justice design and what it reflect the intrinsic value of the program itself-procedural justice.This dissertation can divide into three parts, the first part:the background and origin of Rawls’ theory of procedural justice. In order to discuss the content of Rawls’ theory of procedural justice, this part from the vertical and horizontal two latitude to illustrate Rawls thinking formation of procedural justice. Horizontal is the background of "a Theory of Justice"in which Rawls puts forward the procedural justice, and that background including Rawls personal growth background and social background.The longitudinal is the origin of Rawls’ theory of procedural justice, it include three parts,that is "natural justice"in British,"due process of law"in American and the justice of procedure in other countries of continental Europe.The second part:The analysis of Rawls’ theory of procedural justice. This part mainly analysis the content of Rawls’ theory of procedural justice, I put the content of "a Theory of Justice"and "Political liberalism"as the main line. First i analysis Rawls division on the procedural justice in"a Theory of Justice", That is, perfect procedural justice, imperfect procedural justice and pure procedural justice.And then i analysis personal view on the procedural justice.Second i analysis how Rawls amend the procedural justice and Rawls introduction of the substantive justice and concept of overlapping consistent in "Political liberalism".In"a Theory of Justice"pure procedural justice is the core of Rawls’theory of procedural justice, however, the two principles of justice which used to guide establish social architecture was the core of this book.As Rawls saied pure procedural justice was the way to prove the two principles of justice,and then I would analysis how Rawls through pure procedural justice design to demonstrate the two principle of justice is " the best justice principle by now". Finally I would from the value of the independence,person’s respect, the result of common identity three aspects to talk about Rawls pure procedural justice that embodies the procedure justice value.The three part:Comments on Rawls’ theory of procedural justice. Since Rawls published his book"a Theory of Justice", relevant procedure justice theory and theories appear constantly, including positive response to Rawls and criticism of Rawls. In this part I first discusses significance of Rawls’ theory of procedural justice,and then analyzes many scholars doubts about Rawls’ theory of procedural justice. Rawls’ theory of procedural justice not only has far-reaching influence to Anglo-American system country, and at the same time, also lead the civil law countries such as France, Germany and other countries to program the depth of justice issues. In view of the Chinese nation have heavy entity, light procedure tradition, finally I will analyze Rawls’theory of procedural justice reference meaning.This dissertation mainly adopts the research methods of comparison analysis, historical analysis of law, legal interpretation and so on.更多还原
