【摘要】 贿赂犯罪案件的隐蔽性和对合性,使在贿赂案件中应用污点证人作证制度要比其他案件有更大的价值。本文通过借鉴国外污点证人作证豁免制度,结合我国目前检察机关在侦查贿赂犯罪案件的实践,针对贿赂犯罪过程中取证困难、司法资源匮乏等现状,以及我国司法实践过程,污点证人豁免又广泛被使用在查办贿赂犯罪案件,提出了在贿赂犯罪这个特定罪刑中建立贿赂犯罪污点证人作证豁免制度构想,及自己的意见和建议。更多还原

【Abstract】 In bribery cases, the parallelism and concealment of bribery crimes make the value of applicating the system of exemption of stain witness be greater than any other case. By referring to the stain witness system of some countries and regions, and mainly using the field study of the bribery crime’s cases in China, the article analyses difficulties in gathering evidence of the bribery crime and gives proposal and suggestions to conceive building of such system in China.更多还原
