【摘要】 我国台湾地区“环境影响评估法”制定于1994年，该“法”在制定过程中，吸收了美国和欧洲国家等先进的立法理念与体例，这使该“法”的很多规定具有先进性和合理性。大陆地区的《环境影响评价法》制定于2002年，环境影响评价制度起步早，但发展相对缓慢。虽然大陆学者们对于环境影响评价制度立法相对成熟的美国和欧盟都有较为充分的研究，可是对于学习欧美并将其内化为符合自身传统并可能对我们更有借鉴意义的我国台湾地区的环境影响评价制度尚缺乏专门、深入、系统的研究，因此，选择此课题，希望全面深入研究台湾环境影响评价法律制度及其运行中存在的问题，抛砖引玉、填补此领域研究的不足。本文从分析我国台湾地区环境影响评估制度的历史沿革、内容出发，分析我国台湾地区环境影响评估制度的立法与实践现状及发展趋势，揭示其中的成败得失，探析我国环境影响评价制度其中存在的问题，寻求其中的解决之道，以图为构建和完善我国环境影响评价制度提供参考意见。本文除绪论和结语外，共包括四个部分：第一部分：“我国台湾地区环境影响评估制度概述”，主要介绍环境影响评估制度的涵义、我国台湾地区环境影响评估制度“立法”背景、历史沿革。第二部分：“我国台湾地区环境影响评估制度的基本内容”，主要介绍了我国台湾地区“环境影响评估法”的“立法”宗旨、环境影响评估主体、对象、程序及监督机制等。环境影响评估对象部分重点对比了环境影响评估对象中的开发行为和政策环境影响评估的异同；环境影响评估程序部分重点介绍了开发行为进入第一阶段和第二阶段环境影响评估的程序设计和要求等。第三部分：“我国台湾地区环境影响评估制度评析”，本部分首先介绍了我国台湾地区环境影响评估制度的实际运作概况，从环境影响评估的通过率以及民众参与在环境影响评估两阶段的不同等来了解。然后通过我国台湾地区环境影响评估典型案例“中科三期后里七星基地的环境影响评估争议案”为例，探讨分析了我国台湾地区环境影响评估制度的运作和瓶颈。最后对我国台湾地区环境影响评估制度的得失进行比较评析。第四部分：“我国台湾地区环境影响评估制度对大陆立法的启示”，介绍了我国大陆地区的环境影响评价制度的概况，并结合我国台湾地区的环境影响评估制度的运作和得失总结对大陆地区的启示，并进而提出完善大陆地区环境评价制度的立法建议。更多还原

【Abstract】 Environmental Impact Assessment Law in Taiwan district of China was enacted in1994. It absorbs the advanced legislative concepts and system of the United States andEuropean countries, which makes many of the provisions of the Law advanced andreasonable.Environmental Impact Assessment Law in China’s mainland was enacted in2002.Environmental Impact Assessment system started early, but it develops relatively slowly.Although scholars from China’s mainland have make adequate research on the relativelymature legislation of environmental impact assessment system of the United States andEuropean countries, they did not well on learning from Europe and America as well ason internalizing it to the law consistent with our tradition. Besides, there is lack ofspecialized, in-depth and systematic study on the environmental impact assessmentsystem of Taiwan instructive to us. Therefore, the author selects this topic to conductcomprehensive and in-depth study on Taiwan’s legal system of environmental impactassessment and the problems during its implementation so as to fill research in the field.The thesis starts from the analysis on the history and content of the environmentalimpact assessment system of Taiwan, and then conducts analysis on its legislation,practice and development trend to reveal its advantage and disadvantage, to discuss theproblems of China’s environment impact assessment system so as to seek the solutionand to picture shows the build and improve the environmental impact assessmentsystem in China to provide references on the establishment and improvement of it.The thesis includes4parts except introduction and conclusion.The first part named Introduction to Environmental Impact Assessment System ofTaiwan District of China mainly makes an introduction to the meaning of environmentalimpact assessment system, the legislation background and history of the law in Taiwan.The second part named Contents of Environmental Impact Assessment System ofTaiwan District of China mainly makes an introduction to legislative purpose,assessment subject, object, procedure, and supervision mechanism. The section ofenvironmental impact assessment object makes key contrast on the similarities anddifferences between development actions and policies assessment. The section ofenvironmental impact assessment process focuses on the EIA process design andrequirements during the first and second assessment phases of the development activity. The third part named Analysis on Environmental Impact Assessment System ofTaiwan District of China firstly makes an overview of the actual operation situation ofthe environmental impact assessment system in Taiwan from the perspective ofassessment rate, and the differences of the two stages that the public participates inenvironmental impact assessment. And then, taking the typical case EIA Dispute forexample, the thesis investigates the operation and obstacles of environmental impactassessment system in Taiwan and finally conducts comparison and review on the prosand cons of Environmental Impact Assessment System in Taiwan.The fourth part named Revelation of Environmental Impact Assessment System ofTaiwan on Legislation of China’s mainland makes an introduction to the environmentalimpact assessment system of the China mainland, and summarizes the revelation toChina’s mainland from the analysis on the pros and cons of the operation ofenvironmental impact assessment system of Taiwan so as to put forward legislativeproposals to improve the environmental assessment system of China’s mainland.更多还原
