【摘要】 随着我国受教育权法律救济制度的快速发展，学生申诉制度作为受教育权非诉讼救济途径越来越受到重视，一系列相关法律法规也相继出台。然而，目前的学生申诉制度更多倾向于作为成年人的大学生，不能完全适用于作为未成年人的中小学生。与此同时，近年来关于中小学生教育法律纠纷日益增多并广泛受到社会的关注，而其处理结果却不尽如意，我国的中小学学生制度没有发挥其应有的作用。笔者希望通过对我国中小学学生申诉制度的研究，借鉴英国、美国、我国台湾地区的成熟理论和实践经验，就完善该制度提出一系列构想，以推动我国受教育权法律救济制度的建设、有效保护中小学生的合法权益、监督中小学校园秩序、促进教育事业可持续发展和实现社会和谐。本文分析和讨论了以下四个方面：首先，阐述了学生申诉制度的基本理论，在分析学生申诉制度的概念及特征和阐述中小学生作为未成年人身份的特殊性的基础上，明确中小学学生申诉制度在教育上的功能和价值；其次，进一步对学生申诉制度现状以及近年来中小学教育法律纠纷案例进行分析，揭示其存在的问题并对问题产生的原因进行分析；再次，对英国、美国和我国台湾地区关于学生申诉制度的成熟理论、实践经验进行总结和借鉴；最后，就完善我国中小学学生申诉制度提出了如借鉴民法关于民事行为能力人的划分将学生申诉行为能力进行划分等一系列建议，希望能为我国中小学学生申诉制度的发展提供参考意见。更多还原

【Abstract】 With the rapid development of China’s right to education, legal relief system, thestudent complaints system as the right to education, non-litigation relief means moreand more attention, a series of related laws and regulations have been introduced.However, the current student complaints system more inclined to college students asadults, can not be fully applicable to the primary and secondary school students asminors. At the same time, in recent years, primary and secondary education legaldisputes is the growing number of social concern, the results unpleasantness, China’ssystem of primary and secondary school students did not play its due role. I hope thatcomplaint system of primary and secondary school students in China learn from themature theory and practical experience of the United Kingdom, the United States,China’s Taiwan region, put forward a series of ideas to improve the system in order topromote the building of China’s right to education, legal relief system, effective thelegitimate rights and interests of the protection of primary and secondary schoolstudents, and supervision of primary and secondary schools in order to promotesustainable development and social harmony.This paper analyses and discusses the following four aspects: First, described thebasic theory of the student complaints system in the analysis of the concept andcharacteristics of the student complaints system and described the particularity of theprimary and secondary schools as the identity of minors on the basis of clear primaryand secondary school student appeal system in the function and value of education;followed by further universities, primary and secondary school students in complaintsystem status quo, and in recent years, primary and secondary education law disputecases were analyzed, revealing its existence causes of problems and issues analysis;again.UK, USA and Taiwan of China’s mature theory of the student complaints system,the practical experience to sum up and draw; Finally, to improve the complaint systemof primary and secondary school students in China such as learn from the civil lawdivision of student complaints about the capacity for civil conduct capacity delineationof a series of recommendations to provide a reference for the development of China’sprimary and secondary school students in the complaints system.更多还原
