【摘要】 我国政府已经提出建设创新国家的目标,传统产业作为国家重要的产业部门,在相当长的一段时间内,依然会是国民经济发展的重要组成部分。但传统产业受自身产业特点的限制,发展的步伐相对缓慢。因此,提升传统产业自身的创新能力,就成为促进传统产业发展的必然选择。我国传统产业的技术创新在实践中,不仅仅是资金、资源,环境等某单个的问题,也涉及到财政、税收、成果转化、风险投资和环境保护等方方面面。但我国当前对传统产业技术创新的相关法律的规定相对较少,仅有的相关法律法规也是零零散散,大都内容模糊,缺乏可操作性。因此,本文运用实证分析法和比较分析法,对我国传统产业技术创新的现状进行了分析,从提升传统产业技术创新能力的法律对策的角度,借鉴国外一些国家在促进传统产业技术创新方面的相关法律经验,提出促进我国传统产业技术创新能力提高过程中,应该有侧重的加强相关法律的建设和完善。尤其重视对传统产业知识产权的保护,促进科技成果转化法的实施、制定和落实节能减排等相关能源法律等,以促进传统产业的技术创新能力的提高。本文共六章,全面论述了提升传统产业技术创新能力的法律对策的主题。第一章绪论部分主要是背景介绍；第二章介绍了传统产业技术创新的现状和面临的主要问题；第三章主要介绍了传统产业技术创新所面临的法律问题；第四章集中介绍了国外提升传统产业技术创新能力的法律制度及对我国的启示；第五章作为整个论文的重点章节,笔者提出了对提升我国传统产业技术创新能力法律对策的建议；第六章联系前文对整个论文做了总结。更多还原

【Abstract】 The government of china has put forward the goal of building an innovative country. As the country’s important industrial sector, traditional industry will be still an important part of the development of the national economy. For the restrictions of their own characteristics, the traditional industry has developed with a relatively slow pace. Therefore, to promote the development of the traditional industry, accelerating the technological innovation ability of itself is the inevitable choice. Technological innovation practice of the traditional industries not only concerns the funding, resources and environment, but also relates to finance, taxation and the performance transformation, risk investment and environmental protection and so on.At present, there is a few laws concerned about technological innovation of traditional industry. Moreover the existing laws are fragmented, unstructured and unpractical. the author analyze the status of the technological innovation of traditional industry in China by empirical analysis and comparative analysis, and from perspective of upgrading technological innovation capability of traditional industry, the author advise government to learn related legal experience of some foreign countries on the technological innovation of the traditional industry and to pay more attention to the strengthening of relevant laws, especially the protection of intellectual property rights of traditional industry, the implementation of those laws about the scientific and technological achievements transformation. The legislation and the apply of those resource laws, such as emission reduction law to promote the technological innovation capabilities of traditional industry.It includes six chapters on the theme of the legal measures of the upgrading technological innovation capability of traditional industry. In chapter 1,the author introduce the main background about the traditional industry; In chapter 2 author discussed the status and main problems of the technological innovation of traditional industry.; In chapter 3 author discussed present legal problems on the technological innovation of traditional industry; In chapter 4 the author focused on the related legal system about the improvement of the innovation capability of industrial technology in foreign countries and the enlightenment to our country; Chapter 5 which is the key of the entire thesis, the author proposed legal response to upgrading the ability of technological innovation of traditional industry.Chapter 6 is the conclusion.更多还原
