完善我国现代物流管理体制法律对策研究

【摘要】 现代物流业的发展是客观经济基础和市场法律秩序良性互动的结果。中国物流市场结构已发生深刻变化,作为物流业发展基础的物流法制环境却显得极为滞后,严重制约中国物流业升级换代和整体国民经济结构调整,伴随中国经济发展的脚步,西南边疆地区对外开放、进一步国际化已经成为一项重要的战略。西南边疆地区跨境物流体系的法治构建已成为法学研究的重大理论问题。本文采用理论探讨与立法实践相结合的方法,主要从四个部分分析和论证了我国西南边疆地区物流管理体制和法律体系的构建与完善。首先,从理论上界定了现代物流法律体系的含义,从法理学的角度分析了构建现代物流法律体系的原则和标准,并从实践意义上分析了构建和完善我国现代物流法律体系的必要性。其次,对我国西南边疆地区的物流环境特色和现行管理体制进行分析和总结,找出问题的源头和可能的风险。结合我国物流业现状以及现行的物流立法,指出我国现代物流业以及物流法律法规存在的问题。再次,采用比较研究的方法,对美国和日本的现代物流法律体系进行比较分析,归纳出可资我国借鉴的物流立法经验。最后,依据我国现代物流法律体系构建的原则以及步骤,提出了我国西南边疆地区物流管理体制和法律体系的构建框架,提出构建和完善我国现代物流法律体系中具体法律制度的立法建议。论文研究的目的,是通过对西南边疆地区跨境物流管理体系的管理体制和实际运行中遇到的各种法律制度问题进行研究,并寻找应对之道。为我国西南地区对外开放和经济建设创造良好的法制环境。更多还原

【Abstract】 The development of modern logistics is the results of interaction between objective economic basis and market legal order. Chinese logistic market structure has been undergoing profound changes. However, logistics legal environment, as the foundation of the development of logistics industry, lags far behind, which hinder the upgrading of Chinese logistics industry and the adjustment of entire national economy structure. With the development of Chinese economy, opening to the outside world and globalisation in southwest borderland become an important strategy. How to construct a legal system of cross-border logistics system in southwest has become a major theoretical question. The research in this dissertation is based on this situation.In this dissertation, a new approach of combining theory with practice is used. The construction and improvement of modern logistic management system and legal system in southwest borderland have been analysed and demonstrated into four main parts.First, the term of modern logistic legal system is defined from theory. Then the principles and standards of building modern logistic legal system is analysed in the perspective of jurisprudence. And the significance of construction and improvement of Chinese modern logistics legal system is discussed. Second, the characteristics of the Southwest region’s logistics environment and the existing management system have been seriously analysed and summarised to identify the source and possible risks. Third, a comparative analysis of advanced modern logistics countries such as United States and Japan has been carried out by using comparative approach. The logistics legislative experience could be learned from China have been summarised. Finally, according to the principles and procedures of modern logistics, the construction framework of logistics management system and legal system in southwest borderland is proposed, and the suggestion of building a detailed system of law of construction and improvement of Chinese modern logistics system is given in this dissertation.The aim of the dissertation is to create a good condition for opening up and economic construction of China southwest borderland through the research on cross-border logistics management system the various legal regimes of encountered in actual operation in southwest borderland.更多还原
