电子记录关联取证理论与技术研究

【摘要】 随着计算机网络技术的普及,电子商务以及其它基于网络的活动越来越频繁,产生了大量的文本、图片、合同、订单等电子记录,其中的一些电子记录可以作为法律纠纷中的依据,电子记录做为法律依据使用时,必须保证其真实性,未被伪造或篡改。传统意义上对记录的搜索,通常是在搜索时对记录的某些信息设置约束条件,然后查询出对应的结果,约束条件对应的信息直接以字段的形式存在于数据库中,这种搜索存在一定的局限性,它搜索出来的记录只是满足约束条件的单个记录的集合,记录与记录之间并不存在关联关系。然而,在实际的应用中,记录和记录之间并不是孤立存在的,经常存在着各种各样的关联关系,而且这种关联关系往往不直接以字段的形式存在于数据库中,但是对记录的信息稍加分析后又是显而易见的,这种情况使用传统的搜索方式是无法实现的。本文在使用本体对电子记录进行描述的基础上,通过关系规则来动态描述记录之间的隐含关系,并依据关系包含的规则实现基于规则的关联取证,从而实现传统搜索无法实现的关联取证。同时,通过将电子记录与数字签名结合起来,提出电子记录的关联签名,不仅可以保证电子记录的可信性,还可以不经过搜索过程直接获取与其关联的记录。在计算关联签名时将关联的记录与当前的电子记录关联起来,在对电子记录进行取证时,不仅要取出电子记录的详细信息,还要从记录的签名数据中取出与其关联的记录的信息,并对关联的电子记录中的关键信息进行验证,从而形成基于关联签名的电子记录证据链。本文的创新点和特色之处可以归纳为以下两点:第一,在本体描述电子记录的基础上,根据类和类包含的属性通过SWRL(Semantic Web Rule Language)语言动态创建关系规则,并对关系规则的取证进行理论分析,最终实现基于规则的关联取证;第二,通过研究电子记录的存在形式,完成电子记录关联签名的设计,并实现电子记录关联签名的搜索取证。
【Abstract】 With the popularization of computer network technology, e-commerce and other web-based activities are becoming more and more frequent. Thus, a large number of text, pictures, contracts, orders and other electronic records are generated, some of which can be used as the basis for legal disputes. Before the electronic records are used as evidence, we must ensure its authenticity, it should have not been forged or tampered. Traditional search of records usually by setting constraints of the information which the record contained, and then query the database to get the corresponding results. The constraint conditions often have corresponding fields directly in the database. There are some limitations of this search mode, the results searched by this method can only meet the constraints. There is no relationship among the records. However, the electronic record often exists not in isolation, it usually has relationship with other electronic records in practical applications, and this relationship has no directly fields in database, which can be easily got by anglicizing the information of electronic record. This situation can not be solved by traditional search.This paper dynamically define the relationship between electronic records on the basis of describing the electronic record by using ontology, and then get the related records by analysis the rules contained in the relationship property, which can not be get by traditional search. Besides, we proposal correlated signature by combining electronic records and digital signature, which can not only ensure the credibility of the record, but also get related records without searching. In the calculation of the correlated signature, the information of the electronic records associated with the current electronic record will be added in the signature. The detailed information of the record and the associated electronic records with the record should both be got when we search the record, at the same time, the key information of the associated electronic records should be verified. Finally, we will get a chain of electronic records based on correlate signature.Innovation and characteristics of this paper can be summarized into the following two points:Firstly, use ontology to describe the electronic records, and then dynamically create rules through SWRL(Semantic Web Rule Language) language according to the class and the properties contained in the class, finally analysis the rules contained in the relationship property and realize the related search.Secondly, design correlated signature by anglicizing the form of the electronic records, and then realize the search forensics of the correlated signature contained in electronic record.
