【摘要】 城市发展是一个不断进行城市扩张和再建设的过程，为调整和完善城市功能，需要对不符合城市规划的建筑进行拆除或搬迁，于是就产生了“城市拆迁”。城市拆迁工作对于加速城市化进程，满足城市发展需要，优化城市生存质量，推动经济发展有着不可替代的作用。但由于我国城市房屋拆迁制度不完善，相应的法律法规不健全,一个时期以来，在城市拆迁过程中出现了很多不合理、不合法甚至野蛮、暴力逼迁现象，即所谓的强制性拆迁。这些行为严重侵犯了公民的合法权益，损害了党和政府的形象，影响了社会的和谐和稳定，造成了极其恶劣的社会影响。强制性拆迁已经演化成为我国社会最容易激发矛盾、引起冲突的领域之一。如何防范和规避城市建设中的强制性拆迁，切实维护和保障公民的合法权益，实现公共利益的最大化，成为亟待解决的重大问题。基于以上考虑，本文以“执法为民”为理念，致力于我国城市建设中强制性拆迁问题的研究，以其对强制性拆迁的防范和规避做出力所能及的贡献。本文采用文献分析法、规范分析法和系统分析法等研究方法，在其他学者研究的基础上对我国城市建设中的强拆问题进行认真探讨。具体来说，本文包括以下几个部分：第一部分：即导论和第一章，对城市拆迁的概念、理论及法律依据进行了详细性分析，是本文的理论基础。在本章中阐述了有关公共利益的界定以及其动态确认机制，并且将其作为强制性拆迁的原则。本部分主要运用了所有权社会义务理论、物权自由处分原则、私有财产保护原则、公平正义原则的基本原理，分别从建立政府、拆迁人、被拆迁人三方框架着手，为强制性拆迁的防范做理论铺垫。第二部分：即第二章，我国城市建设中强制性拆迁的现状及出现的问题。本部分首先探讨我国城市建设中强制性拆迁的现状及房屋拆迁中所涉及到的根本问题，并分析拆迁纠纷内在的博弈机理。更多是对城市强拆问题，政府的保护等这些制度性障碍进行全面认识和清晰的分析，探究拆迁纠纷的问题所在，并以典型案例为示范。第三部分，即第三章，我国城市建设中强制性拆迁的对策。本部分在前文分析的基础上，提出了包括贯彻“执法为民”理念、重塑法治观念以及完善法律条例等几个方面的途径来解决强制性拆迁的问题。更多还原

【Abstract】 Urban development is a process of an ongoing expansion and re-building. It is necessary to demolishand move some buildings which do not conform to town planning to adjust and improve the urbanfunctions. Urban demolition is the name given to the above process. Urban demolition plays anirreplaceable role in accelerating the urbanization, meeting the demand of urban development, optimizingurban quality of life, promoting economic development. However, due to China’s incomplete housingdemolition system and distempered laws and regulations, a period of time, in the process of urbandemolition caused a series of unreasonable, illegal and even barbaric, violent coercive demolition, and it’scalled mandatory demolition. They violated the legitimate rights and interests of citizens, and damaged theparty and government’s image of being close to the people, also affected the social harmony and stability,resulted in extremely bad social impact. Mandatory demolition has evolved to become one of the areas inour society most likely to arouse and cause conflicts. How to prevent and avoid the mandatory demolitionin urban construction and earnestly safeguard and protect the legitimate rights and interests of citizens, tomaximize the public interest, have become the major issues to be solved.Based on the above considerations, with a concept of Law Enforcement for People,this thesis iscommitted to the research of mandatory demolition in China’s urban construction, and contribute to theprotection theory and practice of mandatory demolition.This Thesis Adopts literature analysis, specification analysis, and system analysis, on the basis of otherscholars’ research, it conducts serious discussions of mandatory demolition in China’s urban construction.Specifically, this thesis includes the following sections:Part One: Introduction and Chapter I, the theoretical foundation of this thesis, detailedly analyses theconcepts, theories, and legal basis of urban demolition. It states about the demarcation of public interest andas well as its dynamic confirmation mechanism, and as the principle of mandatory demolition. This partmainly used the theory of social obligations of ownership, the principle of property rights freely discipline,the principle of private property protection, the principle of fairness and justice,. Respectively, pave thetheoretical way for the prevention of mandatory demolition in the way of the establishment of government,remover, relocation household. Part Two: Chapter2, the current situation and problems of mandatory demolition in China’s urbanconstruction. This part firstly discusses the currentsituation of mandatory demolition and the fundamental problems that has involved in, and alsoanalyzes the inner mechanism of demolition disputes. More comprehensive understanding and a clearanalysis on institutional barriers of urban demolition and government’s protection. Further makes athorough inquiry the problem of demolition disputes, and demonstrates with some typical cases.Part Three: Chapter3, countermeasures of mandatory demolition in China’s urban construction. Thispart is on the basis of previous analysis, presents the implementing in a concept of law enforcement forpeople, reshapes ideas of law, perfects the regulations and other aspects of the way to solve the mandatorydemolition problems.更多还原
