城市房屋强制拆迁的司法审查程序研究

【摘要】 《国有土地上房屋征收与补偿条例》在强制拆迁引发的诸多恶性事件的压力和公众对新规定的无限期待下,终于在2011年取代原有的《城市房屋拆迁管理条例》,为城市房屋强制拆迁司法审查程序提供了立法上的新依据。然而时至今日,城市房屋拆迁司法审查程序仍步履维艰,未能发挥公众对其所期许的作用。基于此,本文重点在于对城市房屋强制拆迁的司法审查程序进行探究。首先,本文通过对城市房屋强制拆迁司法审查程序中的具体概念进行阐释,厘清城市房屋拆迁的性质和主体之间的法律关系,探讨城市房屋强制拆迁司法审查程序的功能；其次,从我国行政诉讼法的规定和司法审查程序的实践出发,介绍了我国城市房屋强制拆迁司法审查程序中存在的诸多问题,为强制拆迁司法审查程序的构建和完善指出了方向。第三,针对我国强制拆迁司法审查程序中存在的问题,并借鉴国外司法审查的经验,从诉讼主体资格、审查范围、审查标准和裁判方式四个方面提出了构建和完善我国城市房屋强制拆迁司法审查程序的具体构想。以期通过对城市房屋强制拆迁司法审查程序的完善,保障城市房屋拆迁的合法性和合理性,保护公民的基本权益,真正发挥司法审查程序的应有作用。更多还原

【Abstract】 Under the pressure of the constant events triggered by forced removals and expectation of the public to the new regulation,the Tax and Compensation Ordinance Houses On the State-owned Land finally came out and replaced the original Administrative Regulations On Urban Houses Dismantlement in2011, providing new legal basis for judicial review procedures on the urban house dismantlement.But up to now, the judicial review procedures on urban house dismantlement are still hard to put into practice, failing to play the role as the public have expected. Therefore, this paper focuses on the research of judicial review procedures on compulsive removals of urban house. Firstly, the essay clarifies the legal relation between the nature and subject by introducing the detailed concepts in the judicial review procedures on compulsive removals of urban house, and discusses the functions of the judicial review procedures on compulsive removals of urban house. Secondly, from the point of regulations of Administrative Procedure Law PRC and the practice of judicial review procedures, the essay introduces the problems in the judicial review procedures on compulsive removals of urban houses and points out the direction for the construction and perfection of the above procedures.Thirdly, as for the problems in the judicial review procedures on compulsive removals of urban houses in China, the essay provides specific ideas, taking the foreign experiences for referee, for the construction and perfection of judicial review procedures on compulsive removals of urban houses from four points of litigation subject, review scope, judging standard and judging way. Through perfecting judicial review procedures on compulsive removals of urban houses, the essay aims to ensure the legitimacy and rationality of the urban houses’dismantlement, protect the interest of the people and play its true role in judicial review procedures.更多还原
