【摘要】 我国新一轮的集体林权制度改革已经接近尾声,全国各省份的主体改革基本完成,相应进入到配套措施阶段。在集体林权改革的众多配套改革措施中,集体林权的流转是重中之重,它既关系到林农的切身利益能否实现,又是我国林业实现规模经营以及长远发展的重要途径,因此对于集体林权流转的专门研究是至关重要的。本文所研究的集体林权流转是市场经济的必然产物,因此本文首先对林权流转市场中各要素进行逐一分析,对市场各要素的特征、在流转市场中扮演何种角色、发挥何种作用都进行了明确的解释,在此基础之上总结了各部分之间的逻辑关系。在市场要素分析的基础之上,本文进一步追溯集体林权流转发生的根本原因,并对流转发生的必然性进行深入分析,从市场要素构成角度,规模经营角度以及国家相关政策法规角度三方面进行逐一分析,并归纳总结出集体林权流转是市场经济的必然结果。林权流转的必然性分析说明林权流转的发生具有不可阻挡的趋势,然而在实际操作过程中究竟表现如何,本文继续以新一轮集体林权改革的开始为分界点,通过分析比较集体林权制度改革前后两段时期的流转现状,突出新一轮集体林权改革背景下的林权流转是以市场导向为主的,主要以市场机制配置林地、林木资源。在对集体林权流转现状进行分析的同时指出现阶段林权流转的问题所在,同时对存在的现状进行障碍分析,得出阻碍林权顺利流转的因素主要有流转双方的信息不对称,流转中各市场主体的操作不规范以及流转后的管理和监督工作欠缺。在本文最后一部分,通过总结前文内容并综合文章主旨,构建了有效的集体林权流转机制,包括集体林权供给方和需求方之间的价格机制,集体林权流转中介机构的辅助服务机制,政府及林业相关部门的引导和监督机制。三个机制之间相互联系、相互支撑、相互制约,价格机制是集体林权流转的依据,价格机制的形成依赖于中介辅助机制,而政府的引导监督机制同时监督和控制集体林权流转市场中的各个主体及其流转行为,也是提高林权流转效率很重要的机制,在林权流转过程中发挥着重要的作用。更多还原

【Abstract】 The new reform of collective forest rights is near the end in our country. Almost every province is fairly complete the main reforms, corresponding to the stage of reform of the corresponding measures . In many subsidiary reform measures of the forest rights reform, the forest right transfer is the top priority. It is related to the realise of the immediate interests of the farmer, and it is also the important ways to realize scale management and long-term development of our forestry. It has basically completed the work of affirming rights and license issuing this year in Hebei province.What the paper discusses the forest right Transfer is a kind of behavior which happened in the environment of market economy, and it should be first to analyze the factors among the forest right transfer market. The paper analyzes the characteristics of each part, what kind of role in transfer market, and what effect they will make, it also clear the relationships between the parts. The forest right transfer is not an accidental act, but an inevitable result under all sorts of the conditions . These include the basic conditions of the forest right transfer happen with, that is both the subject and transfer object, the scale operation philosophy becoming more popular, and in government and related departments of forestry to promote guidance, the forest right transfer behavior occur naturally.The analysis of the necessity of forest right transfer shows that the forest right transfer has a unstoppable trend, however, in the actual operation process of how what performance, In this paper it takes the start of the new collective forest rights reform as the boundary, and then through analysing present situation before and after the transfer of two periods, so as to highlight that the transfer is guided mainly by market under the background of the collective forest tenure reform, and the forest resources mainly be allocated by market mechanism. In the analysis of the present situation of forest right transfer at the same time puts forward the forest right transfer problem, and at the same time to the existing situation of obstacles and analysis of the forest right smooth transfer that are the major factors of both parties of the transfer of information asymmetry, transfer of the main body of the different market operation is not standard, the transfer management and supervision of the lack of work.In the final part of this paper, through summing up above content and comprehensive the main idea, it structures an effective forest right transfer mechanism. Including forest right suppliers’ and the price mechanism between home-textile, forest right transfer of intermediary institutions auxiliary service mechanism, the government and related departments of forestry the guidance and supervision mechanism. Between three mechanism, they contact internally also restrict each other, price mechanism is the basis of the forest right transfer. And the formation of price mechanism rely on assistant mechanism, and the guidance by the government supervision mechanism and supervision and control of the market main body and its transfer parties flow behavior, and forest right transfer high efficiency of the very important mechanism.
