学校食堂食品安全监管行政指导问题研究

【摘要】 学校食堂食品安全监管行政指导,对于预防学校群体性食物中毒事故的发生,确保师生就餐安全,探索食品安全监管行政指导在实践中的运用,具有重大理论价值和现实意义。本文运用规范分析、资料分析、实地调查、专家咨询、比较研究、交叉研究、实证研究、对策研究等传统和现代的研究方法,对学校食堂食品安全监管行政指导的理论和实务进行深入研究。分析了构建学校食堂食品安全监管行政指导干预机制的可行性,即其社会基础和功能价值；探讨了学校食堂食品安全监管行政指导干预机制的构建原则,即合法与合理并行原则、公平与效率协调原则、权力与权利平衡原则；并针对性地提出了构建学校食堂食品安全监管行政指导干预机制的路径选择,即通过建立意见听取制度和信息公开制度,实现行政指导的制度化路径；通过确立统一的行政指导规制和规范行政指导的救济制度,实现行政指导的法治化路径。更多还原

【Abstract】 School canteen food safety regulatory administrative guidance is a major theoretical and practical research topic, to prevent group food poisoning incidents in school, to ensure the safety of students and teachers eating and to research the methods to practice the food safety regulatory administrative guidance.In this paper, normative analysis, data analysis, field surveys, expert advice, comparative studies, crossover study, empirical research, countermeasures and other research methods are involved to study the theory and practice of the school canteen food safety regulatory administrative guidance. This paper analyzes the feasibility to build the intervention mechanism of school canteen food safety regulatory administrative guidance, that is, the value and social foundation of administrative guidance; it investigates the construction principles of the school canteen food safety regulatory intervention mechanism, namely the parallel principle of legality and rationality, the principle of co-ordination for fair and efficiency, the balance principle of power and rights; and brings forward the way to build the school canteen food safety supervision administration, i.e. the way to establish hearings system and information disclosure system to achieve the institutionalization of administrative guidance; and institutionalize administrative guidance through the establishment of a unified administrative regulation and standards to guide the relief system of administrative guidance.更多还原
