电子支付法律问题研究

【摘要】 近些年来,随着电子商务的发展和计算机网络技术的进步,电子支付逐渐在人们日常生活中扮演越来越重要的角色。但是,从目前我国对电子支付的监管来看,现实并不尽如人意。电子支付立法尚不够完善,不能够满足其在现实生活中的需要,这对电子支付的发展十分不利。本文从电子支付的基本理论出发,综合运用了历史、比较和实证等研究方法,分析了电子支付与传统支付方式的异同,从而引出了采用电子支付方式存在的安全、民事法律责任承担、消费者权益保护和监管问题,在最后一部分中,通过参考其他国家和地区的实践经验并结合我国的现实状况,对电子支付的立法提出几点建议,希望能以此为我国电子支付法律制度建设献上一份微薄之力。更多还原

【Abstract】 In recent years ,with the development of e-commerce and computer network technology,electronic payment is playing a more and more important part in people’s daily life . But, according to the current situation of our country’s supervision and control on electronic payment, the reality is not optimistic. The legislation of electronic payment is still not perfect and it can’t satisfy the needs in real life. This kind of situation is bad for the development of electronic payment.This article starts from the basic theories of the electronic payment, comprehensively uses history, comparative and empirical research methods and analyzes the similarities and differences between electronic payment and traditional payment methods. After these discussions, this paper discusses the problems of security, civil legal liability, the protection of consumers’ rights and the supervision during the payment process. In the last part, the author put forward several proposals on the legislation of electronic payment by referencing the practical experience of other countries’and the reality of our country, hoping to make a contribution to the construction of Chinese electronic payment legal system.更多还原
