【摘要】 我国检察机关是国家法律监督机关,是中国政权建设和法制建设进程中的历史选择,承担着维护社会和谐稳定和公平正义的重要职责。检察机关的各项职能都与建设社会主义和谐社会密切相关,在贯彻依法治国基本方略、维护社会和谐稳定、积极化解社会矛盾、促进社会公平正义方面具有不可替代的作用。党的十七大提出“全面落实依法治国基本方略,加快建设社会主义法治国家”和“深化司法体制改革”,给检察工作指明了前进的方向,明晰了奋斗目标。检察工作一体化机制就是响应党的号召,落实“深化司法体制改革”,对检察机制进行的一种创新,本文试就此问题进行探讨。本文由四部分构成,第一部分着重介绍检察工作一体化的相关理论,辨析“检察工作一体化”、“检察一体化”、“部门一体化”,同时分析了实施检察工作一体化的的该当性,以及分析检察工作一体化的一个重要因素一一检察权的属性,提出检察权属于偏向司法权的复合性检察权,这对检察工作一体化的边界有重要意义。第二部分对重点分析了我国检察工作一体化机制在运行过程中所暴露出的问题,同时分析了国外的检察一体化制度,并分析了国外检察一体化制度的特点,对我国检察工作一体化有借鉴作用。第三部分构建我国检察工作一体化机制,分析我国检察工作一体化的未来,提出要通过外部机制变革去保障检察工作一体化机制的实现,主要是通过改变领导模式,创新财政制度,建立人事保障体系和利用科技等几个方面去构建外部环境,同时还要检察机关内部不断完善,从而保障检察工作一体化机制的实现,主要是通过建立书面存档制度,责任明晰制度,以及对检察机关的机构重新设置去不断完善检察工作一体化机制。第四部分为结束语。本文主要采用文献研究法、经验总结法、描述性研究法、考察比较法和探索性研究法,从检察工作一体化的内涵入手分析,对比国外检察一体化制度,分析其特点,综合分析我国检察工作一体化的现状,找出存在的缺陷与不足,最后提出相关的解决措施。更多还原

【Abstract】 The procuratorial organs are legal supervision organs, are the Chinese regime and improving the legal system in the process of historical choice,and undertake maintaining social harmony and stability and an important duty of fairness and justice. The functions of procuratorial organs are closely related to the construction harmonious socialist society, there is an irreplaceable role in the field of implementing the basic strategy of Country according to law, maintaining social harmony and stability and resolving social conflicts and promote social equity and justice. In the seventeenth central committee of the Communist Party of China it brings forward’fully implementing the basic strategy of Country according to law, accelerates the construction of a socialist country ruled by law’and’reform of the judicial system’,it points out the direction of the procuratorial work, makes to clear our goals. the mechanisms for procuratorial work integration is an attorney mechanism of an innovative responsing to the call of the Party and putting the ’reform of the judicial system’into effect.This paper try to discuss this issue.This article includes four parts.The first part focuses on describing the theory of the mechanisms for procuratorial work integration,differentiates ’procuratorial work integration’,’attorney integration’ and ’sectoral integration’,and analyses implementing procuratorial work integration justifiability, and analysing an important factor of procuratorial work integration-Prosecutorial Power, proposed is biased prosecutorial power of judicial power, prosecutorial power complex, which borders on the integration of prosecutions is important. The second part analyzed the mechanisms for procuratorial work integration during the operation of the problems exposed by the same time, the integration of the system of foreign prosecution, and analyzes the characteristics of the system integration of foreign prosecution, prosecutors working on the integration of Serve as a reference. The third part constructing the mechanisms for procuratorial work integration, analysis of the future integration of prosecutions proposed changes through external mechanisms to protect the prosecutions to achieve integration mechanisms, mainly by changing the model of leadership, innovation, financial system, the establishment of the personnel security system and the use of science and technology aspects to build the external environment, but also the internal organs of prosecution continued improvement of the integration mechanisms in order to protect the realization of prosecutorial work, mainly through the establishment of a written filing system, the clearing system of responsibility, as well as the prosecution agencies Re-set to continue to improve the mechanisms for procuratorial work integration. The fourth part is the concluding remarks.This paper uses literature research, lessons learned method, descriptive study, study and exploration of comparative law study, the integration of work from the connotation of prosecution analysis, comparing the integration of foreign prosecution system, analyze its characteristics, comprehensive analysis of the Prosecutor the status of the integration work to identify the defects and shortcomings, and finally put forward relevant solutions.更多还原
