【摘要】 人肉搜索伴随网络时代而出现,是指以网络为平台,以网民为资源,逐渐获取某个人或某些人信息,通过整理分析这些信息并找出某个人并确认某个人信息的过程。人肉搜索有利于形成全新的民众参与和监督形式,并促进信息在网络状态下的快速流通。但是,人肉搜索过程中却因主体的虚拟存在而易于造成他人人身权益之侵害,甚至造成社会秩序混乱。遂在理论及立法上出现废弃人肉搜索的行动,但是,依存网络是现代人的生活方式,如因人肉搜索有其负面效应就弃之,显属背离了人生的目的本身。正确的立场应该是立足于现实生活,在考量言论自由、私权保护等价值冲突的基础上,对人肉搜索中产生的侵权责任在构成要件各方面特点进行深刻把握,在精神损害、惩罚性损害赔偿等责任实现领域加以制度建构,以对人肉搜索中的侵权责任进行有效规范,确保人肉搜索的存在不以损害他人人身权益为代价。人肉搜索中侵权责任对社会安定同时产生外部性,各国对此采取了不同的应对措施,形成不同的规制模式。我国应立足国情,尤其是考虑传统文化,采取立体化监管模式,并落实到具体的监管制度。更多还原

【Abstract】 The human-powered search appeared with network times, which is refers to the Internet as a platform, As netizens for resources, and get someone or some information Gradually Through sorting out and analyzing these information and find someone or confirm a personal information process. Human-powered search is conducive to form new people to participate in and supervision form and promote information in network under the condition of rapid circulation. However, because of subject of virtual existence the Human-powered search process, which is easy to cause the other person rights violations. Even cause social disorder. Hence in theory and legislation appeared to abandoned human-powered search action. But, Interdependence network is a modern way of life, If give it up because of human-powered search its negative effect, that means genera against of the purpose of life itself. The right position should be based on real life, On the base of considerations freedom of speech and privacy protection value conflicts. Understanding all aspects’various characteristics of constitutions of tortuous liability in Human-powered search. In order to realize system, we have to make further perfections on the mental damage, punitive damages responsibility and so on. For the tort liability of Human-powered search’s effectively regulated. Ensure the existence of human-powered search without damage of other person rights as cost. The tort liability of Human-powered search for social stability also produces externalities. All countries take different measures and forming different regulation mode.
