【摘要】 当前我国船舶选择悬挂方便旗给我国带来了一系列负面影响：从宏观航运安全及航运市场方面考虑，方便旗会涉及到航运安全，同时方便旗还会加剧航运市场的不公平竞争，由于方便船籍国宽松的登记条件和种种优惠政策，使方便旗船经营人的经营成本大幅降低，又无需为船舶的经营利润纳税，从而对其他没有取得方便旗的船舶经营人造成了不公平竞争。因此，在我国提出建设国际航运中心的过程中，如何保持我国船队的稳定性，将其吸引回国，保证我国船队的规模已经成为一个重要问题。在许多海运大国纷纷提出第二船籍登记制度的时候，我国船舶登记制度改革也应该提上议事日程。本文认为高额的税收机制、船员因素、逃避监管、造船融资因素导致了我国船舶移籍海外，我国现行的严格登记制度也不利于解决上述问题。应利用第二船籍登记制度在税收优惠、船员国籍、船龄限制、船级社准入条件方面的突破来解决船舶移籍海外的问题。更多还原

【Abstract】 Some chinese ships that are chosen to fly”flags of convenience” havebrought a serices of negative effects in china.From the considerations ofmacroscopic shipping safety and shipping market,flying”flags ofconvenience”will influence the shipping safety and aggravate the unfaircmpetition in shipping market.The relaxed rigistration condition andvarious preferential policies which make the owners of the conveniencebanner ships reduce the opetating cost greatly and do not need to pay theoperating profit tax.Above all,it is unfair to the owners of the shipswithout”flags of convenience”.Therefore,in the process of constructing the interational shippingcenter,it has become a great issue that how to maintain the stability andscale of chinese fleets and to attract them to come back to thematherland.At the time that many shipping powerful countries putforward secondary ship registry system.the reform of ship registrationsystem in our country should also be put on the schedule. The paper believed that the high taxation.the factors of crew,evadingof supervision and financial factors of shipbuilding led to chinese shipswere registed in foreign countries.The strict ship registrationsystems,currently in effect in our country is not to solve the problems.Weshould use the breakthrough of the secondary ship registration system inthe scale of tax concessions.the nationality of crew,the limitation of ship’sage and admittance condition of classification society to slove the aboveproblems.更多还原
