【摘要】 著作权人保护权利的强势扩张,公众合理使用作品的空间被挤压。网络技术的普及,使作品的创作、发表及其数字化过程变得简单、高速和便捷的同时,也使作品复制日趋完美,网络盗版时有发生。著作权人日益倾向采用“技术措施+合同+法律”的综合保护模式全面控制作品,使作品完全商品化。越来越多的作品被“拥有”,公众合理使用作品的权利受到限制,著作权法的公共政策目标无法实现。知识共享许可协议为著作权人行使著作权提供了一种新的选择,也为平衡著作权人利益与公众利益提供了一种新思路。本文首先对知识共享许可协议产生的思想渊源及知识共享许可协议的现状进行了介绍;然后对知识共享许可协议当事人资格进行了分析,得出结论认为只有完整受让作品著作权的权利人才有资格对作品进行知识共享许可协议授权;之后就知识共享许可协议当事人利益问题进行了分析,得出采用知识共享许可协议是当事人在网络时代新的选择,对当事人来说其利大于弊;最后就知识共享许可协议存在的问题,从知识共享许可协议核心授权要素“非商性使用”的界定、知识共享许可协议兼容性、知识共享许可协议著作权保护等几方面提出了几点建议。更多还原

【Abstract】 The right of the copyright owner had strong expansion, the space of public’s fair use had been squeezed; Popularization of the network technology, make of the writing, publishing and digitalized process becomes simple, high-speed and convenient, but works increasingly perfect replication, online piracy occur frequently. The copyright owner increasingly tend to control works by‘technical measures + contract+law’Comprehensive protection mode, make work completely commercialization. More and more work was to‘own’, the rights of Public use works is restricted, copyright law of public policy objectives can not be achieved. Creative Commons provides a new choice for the copyright owner to exercise copyright, Also makes a new way of thinking to balance the copyright owner’s interests and public interests.First this paper introduced the thoughts origin of Creative Commons Licenses and the present situation of Creative Commons Licenses; second analyzed the parties’qualification of Creative Commons Licenses, that only completely obtained copyright authorized obliges can use Creative Commons Licenses on their work. Third analyzed the interests of party who adopted Creative Commons Licenses, The conclusion was that Creative Commons Licenses is the beneficial choices for the parties in the network times , the advantages far outweigh the disadvantage. Last analyzed the existing problems of Creative Commons Licenses, offered several Suggestions from definition of Creative Commons Licenses core authorized‘Not Commercial Use’, the compatibility of Creative Commons Licenses and Creative Commons Licenses copyright protection.更多还原
