【摘要】 传统的法制观,强调经济基础对法的决定性作用,强调法的工具价值。这种观念反映在当前的行政管理中,产生了与社会主义法治要求不相符合的种种问题。从法治思想的起源,以及它在西方两千年的发展历史来看,是一种带有强烈理念色彩的理论。因此,在法治实践的过程中,要重视法治的理念属性。社会主义法治对以往优秀的价值观具有兼容并包性,它能够吸纳西方传统法治观念中的先进理念,并从社会主义的原则出发,比以往的法治类型更为优越,体现了其特有的价值性。社会主义行政法治的实现,一方面必须要注重法治所固有的古典自然主义理论基础,注重法治的价值理性,遵循法的本质规律,从法治的原则出发,树立秩序、公平、民主的价值目标,唤起人们对于行政法治的认同感,促进法律的良好运行。另外一方面,社会主义行政法治的价值目标,要从社会现实出发,要符合社会主义原则,符合人性需要,规范权力运行,解决行政管理中不适应社会发展,不符合社会公众要求之处。正是在这两点上,社会主义行政法治才具备其应有的价值。目前,社会主义行政法治,在价值目标方面还不够明晰,缺乏对社会主义行政法治价值目标的深层次辨析,也因此没有建立属于社会主义性质的法治模式。从社会主义行政法治价值目标实现的障碍来看,由于受传统价值观影响,受工具主义法学思想的影响,以及法治信仰的缺失,我国社会主义行政法治价值目标的建立,还有很长的历程要走。更多还原

【Abstract】 The tradithional opiniones of about law stipulitions,pay more attion on the dicisive roleof the fundmental to it,and the instrumentalism rationality. This kind of idea reflected in thecurrent administration,is the conflicts which does not conform to the socialist rule of lawrequirements .From the origning of the theories of the rule of law,and the history in the pasttwo thousands in the west,it was a kind of thought with more dealism,therefore,we shouldnever ignore the the idealism of it in practicing. The rule of the socialist law,based on theSocialist principles, could open to all the excellent old theories, and absorb the advancedpart of the rule of the law in the west, more superior than the previous type of the rule oflaw in the past,will show its unique value of existence in the future. In order to reliazing theadministration on the rule of law,on the one hand,we must attach importance to its basic—classic natural theories,to the rational value of itself,and abey to the essence rule about thelaw,start from the princeples of the law,establish the value goal about order,the justise,thedemocacy, arouse the people’s agreement to the administration on the rule of the law,andprompt the law running smoothly.on the other hand, the value goal of the andministration onthe rule of law,should be base on the sociaty realities,in according to the the princeple of thesocialism ,the humanity,and should to rugulating authority running,to sole the problemes inthe administrative management can’t adapt to the social development,can’t adapt to thepeople’s needs,just to this two points,the value of the administration on the rule of law can beachieved. Now,the value goals of the administration on the rule of socialism law are still notclear,and short of deep analysis on it,even not established the socialism model aboutthat.influnced by the tradithional value,by the law theories about the instrumentalranationality,and the fact that was not established the brief to the law,the barriers to realizing the value goals of the administration on the rule of the socialism law still make it have verylong way to go.更多还原
