【摘要】 网络隐私权是伴随着网络时代的到来而兴起的一个新概念,如今我们国家在网络技术方面取得了突飞猛进的进步,计算机网络技术的快速发展对我国公民网络隐私权的法律保护提出了严峻的挑战,这同时也会严重影响我国互联网经济发展的进程。由于我国公民保护网络隐私权的意识比较薄弱,这些导致现实中我国公民网络隐私权被侵犯的现象越来越严重。加强对公民网络隐私权的法律保护,构建我国网络隐私权的法律保护体系已成为我国网络隐私权立法当务之急。本文大致分成六个部分对选题进行深入的论述:第一部分为引言,通过对现实生活中网络隐私权纠纷的典型案件进行案情介绍,引发思考,为下文的理论阐述做铺垫,提出公民隐私权保护相关的问题。第二部分对隐私权以及网络隐私侵权相关理论进行详细的概述。首先阐述传统隐私权概念、特征。由于我国的传统法律对隐私权的保护通常通过名誉权而实现,我们有必要对两者进行区别。其次,本段阐述网络隐私权的有关理论包括:网络隐私权的概念、特点,侵害网络隐私权的主要危害、主要类型、以及侵权行为的责任构成等。第三部分阐述国外关于网络隐私保护的研究。通过外国三种网络隐私权保护模式的介绍、分析比较,为我国的网络隐私权的法律保护模式的选择提供借鉴经验。第四部分,介绍我国网络隐私权法律保护的现状。通过介绍我国传统网络隐私权保护,以及最新的《侵权责任法》对公民网络隐私权保护,通过列举我国目前阶段对公民网络隐私权保护的不足之处,这样使我国的相关法律逐步得到完善。借鉴国外的网络隐私权保护方面的经验,结合我国的国情,为制定出适应我国国情的网络隐私保护模式提供参考。第五部分,为了使我国的网络隐私权保护更加规范,为我国的网络隐私权保护提出几点建议。更多还原

【Abstract】 Network privacy is a new concept developed with the network. nowadays, Our country has made enormous progress in the technology of network. However, with the rapid development of the technology of network, law protection of our citizens’network privacy proposes severe challenges,which also has hampered the progress of network economy. Because the privacy provisions has a lot of shortage , at the same time the consciousness of our citizens about network privacy protection was weak . These lead to infringement phenomenon of network privacy of our citizens more and more seriously in reality. In recent years,to strengthen the legal protection of network privacy right and construct the legal system for it in China is an urgent and necessary task for Chinese governments.This article is divided into seven parts:The first part is introduction, through introducing and analyzing of network privacy typical cases in real life, which is the groundwork of the following theoretical elaboration, and put forward the citizens privacy protection related problems.The second part is on the basic theory of privacy and network privacy. Firstly, I describe the concept of traditional privacy, and elaborate the general theory about the concept principal character. The tradtional protection of privacy is through the protection of the Right of Honour, so we need to distinguish the Right of Honour and Right of Privacy. Secondly, this part is of the network privacy theory including the concept, features of the network qrivacy, the main harm and types of the network qrivacy infringement , and the formation of legal liabilities of the network qrivacy infringement.The third part introduces the international research experience of protection network privacy. Through analyzing three international models, I provide experience for law protection of our country’s network privacy.The fourth part introduces the current situation of law protection of our country’s network privacy. Firstly, I introduce the traditional laws of network privacy and the latest“Tort Liability Law of the People’s Republic of China”.Then I conclude the existing deficiency of the law protection of our citizens’network privacy. I think the law protection system of our citizens’network privacy will be improved .I think that we need to learn more from the international experience of protecting network privacy, unify our country national condition to develop the network with Chinese characteristics.At the same time ,I provide some privacy protection modes of development proposals.In the last part, in order to promote the law protection of our network privacy more standardized, the paper gives some suggestions on the development of the law protections of our network privacy.更多还原
