【摘要】 本文的研究目的：通过重新审视并深入剖析现行的国家和省级线性工程项目建设用地制度,提出对西北地区乃至全国国家和省级重点线性工程项目依法依规用地的政策建议。研究方法：在深入细致地归纳和梳理现行的国家和省级线性工程项目建设用地管理制度以及国际金融危机以来国土资源部出台的与国家和省级重点项目有关的政策措施后,运用成本效益分析方法,总结提炼出与该制度建立和实施有关的各项成本和效益,并通过分析制度总成本构成因素与制度总效益构成因素的相互关系及影响,展开西北地区实证分析,指出影响现行制度总效益不高的制度障碍和缺陷问题。研究结果：一是现行国家和省级重点线性工程项目建设用地管理制度是由包括土地管理法等多部土地相关国家法律及其实施条例,国土资源部等国务院多个部委局部门规章,以及地方各级人民政府及其国土资源行政主管部门地方性法规和地方部门规章等在内的庞大制度体系,是一条“制度束”；二是该制度束中的某些法律之间还存在不协调之处,某些政策性文件之间还存在与实际相脱节之处。研究结论：基于成本效益角度对该制度束的分析,有效地分析出其在建立体制、实施机制等方面存在的问题,从而指出近年来西北地区大量国家和省级重点线性工程项目违法用地与重点线性工程项目建设用地管理制度总效益不高有直接的关系,并有针对性地提出了相应的政策建议。更多还原

【Abstract】 The Research purpose:Through reconsidering and thoroughly analyzing building land mechanism of the current national and provincial linear engineering, the paper puts forward advice on the policy of national and provincial linear engineering projects in the northwest and the whole China. Research method:Through introducing and combing out the current building land mechanism and control system of national and provincial linear engineering and the strategies which are relative to national provincial key projects and put forward by Ministry of Land Resource after international financial crisis, the thesis use cost benefit analysis method and conclude the costs and benefits which are related with the establishment and implementation of this system, and through the analysis the relationship of total cost components and total benefits components and empirical analysis on the northwest region, points out the obstacle problems and defects that affect the total efficiency of current system. Result results:Firstly, the current national and provincial key linear projects construction land management mechanism includes the huge mechanism system made up of land-related national law and its implementation regulations (Land Administration Law of P.R. China etc.), regulation of many national ministries (e.g. Ministry of Land Resources), regulation of the local People’s Government and Land Resources Administration Departments at all levels and regulations of the local sub-departments. That is so-called "Mechanism Bundle"; secondly, there is incompatibility among several laws in the bundle. In some political documents, the problem of being away from reality exists. Research Conclusion:Based on analyzing this mechanism from cost perspective, the thesis analyzes the problems under the mechanism construction, implementation mechanism, etc. in order to put forwards the direct relationship between the illegal land use of national and provincial key linear projects in northwest districts and the low total management benefits. In the end, the thesis also proposed the strategies and advice on solving the problems.更多还原
