行政事实行为救济研究

【摘要】 随着国家向服务行政与给付行政的发展,政府越来越凭借行政事实行为实现行政职能,行政事实行为的角色越发重要。行政事实行为是一种职权行为,是执行法律的行为,应当受到法律的制约,并且遵循依法行政的基本原则。将行政事实行为纳入行政诉讼受案范围是现代行政法治发展的必然要求,也是为了给行政相对人提供充分救济的需要。本文共分三章：第一章,行政事实行为的界定。本章考察了大陆法系国家及我国对行政事实行为的界定,同时考察了与行政事实行为相关概念,在此基础上,对行政事实行为概念进行了尝试性概括,行政事实行为的特征有：由行政机关做出；行政机关行使公权力的行为；针对特定的相对人的行为；直接的法律效果；是单方行为。行政事实行为包括执行性行为、日常的建设、维护行为和暴力侵权行为。第二章,分析了我国行政事实行为救济的现状,介绍了有代表性国家行政事实行为救济制度,主要从实务的角度对我国行政事实行为救济制度现状进行了考察。第三章,构建我国行政事实行为救济制度,借鉴域外的行政救济制度,针对工作实际,提出从扩大受案范围、放宽原告资格、完善判决方式及行政赔偿诉讼制度等四个方面,阐述构建我国行政事实行为救济制度的意见。更多还原

【Abstract】 With pays the administrative development along with the country to the service administration, the government relies on the administrative fact behavior to realize the executive functions more and more, the administrative fact behavior role is even more important. The administrative fact behavior is one kind of authority behavior is the dispensing justice behavior, must receive legal the restriction, and follows administration according to law’s basic principle. Integrates the administrative proceedings the administrative fact behavior the document scope is the modern administration government by law development request inevitably, is also to give the administrative relative person to provide the full relief the need.This article is divided three chapters:The first chapter administrative fact behavior limits. This chapter inspected the mainland legal system country and our country to the administrative fact behavior limits, simultaneously inspected with the administrative fact behavior related concept, based on this, has carried on the experimental summary to the administrative fact behavior concept and the characteristic. The characteristic includes:must make by the Administrative organ; must be the Administrative organ exercises the civil rights strength behavior; must be the behavior which to the specific citizen, the legal person or other organizations makes; must produce the direct legal results; must be the folk remedy behavior which the Administrative organ makes.
