【摘要】 行政协助制度在法治发达国家(地区)有着详尽的法律规定和广泛的实际运行,在我国行政实践中也为行政主体所自发运用,但在我国却没有统一的立法规定、完备的法治理论研究,制度运作还处于白发的无序状态,现实上的缺失严重制约了协助功能的发挥。为此,需要对行政协助制度给予更多关注,从行政法治理论上进行深入研究,在行政立法上进行详尽设计,从行政实践上进行法治化运作。全文共分为六章：第一章,引言。第二章,行政协助制度的基础理论。本章先通过列举分析我国学者们有关行政协助制度概念的表述,结合自身对该制度认识,给出本文对于行政协助制度的涵义界定。再通过分析该制度的特征,提出指引制度运作的基本原则,根据不同标准进行政协助行为分类,辨析行政协助与相关概念的异同等方式,对行政协助制度作一个基本的阐述。第三章,行政协助制度的比较考察。本章通过列举有关域外国家(地区)关于行政协助制度的立法规定,并对行政协助制度适用情况、制度运作所要遵循的程序等进行具体比较分析。第四章,我国行政协助制度的现状及存在的问题。本章对我国行政协助制度的立法及实践现状进行了深入考察,从中发现其在立法与实践运作上的不足。第五章,我国行政协助制度的完善。在前述厘清有关行政协助制度的基本问题的基础上,借鉴有关域外的先进经验,针对行政协助制度在我国立法与实践上的现状与问题,给出制度完善方案。从行政协助制度的参与主体、职权、发生时间、具体程序、功能认识等各方面进行完善。第六章,结语。更多还原

【Abstract】 Assistance administration system has the detailed legal rule and universal application in the developed countries or areas, and is spontaneously applied in our country’s practices, however, there is no unified legal rule or complete theoretic research and system operation is in spontaneous and mussy disorder, then the deficiency restricts the function of administrative assistance. Therefore, we need to pay more attention to assistance administration system, research the administrative legal theory deeply, design the administrative legislation elaborately and operate in administrative practices legally.This paper has six chapters:Chapter 1, introduction.Chapter 2, basic theory of assistance administration system.Analyzing the existed concepts of assistance administration system and combining my own understanding, this chapter defines assistance administration system. Studying the characteristic of assistance administration system and propose the basic principle guiding the system operation, this chapter illustrates the assistance administration system by classifying the administrative assistance according to different standards and discriminate the administrative assistance and related concepts.Chapter 3, comparison of assistance administration system.This chapter lists other countries or areas’legal rule of assistance administration system and compares the appropriateness of assistance administration system and procedures of system operation.Chapter 4, status quo and problems of Chinese assistance administration system.This chapter analyzes the status quo of Chinese assistance administration system’s legalization and practice and find out the defects.Chapter 5, improvement of Chinese assistance administration system.Realizing the above defects, this chapter provides the schemes by referring to other countries’ advance experiences and being specific to status quo and problems of Chinese assistance administration system.
