【摘要】 2008年6月1日施行的《禁毒法》,首次明确了强制隔离戒毒,这是我国禁毒立法的重要成果之一,强制隔离戒毒相对原来的强制戒毒和劳动教养戒毒而言是一次突破和创新,是立法部门积极应对国际社会抨击,进一步完善我国禁毒立法体制,体现以人为本的戒毒理念而做出的一项重大改革。强制隔离戒毒制度正式实施以来,对帮助我省吸毒人员戒除毒瘾回归社会,降低毒品滥用引发的各种危害起到了十分重要的作用,但从调研的情况来看,由于受执法环境的限制,监督机制的缺失,经费投入不足等因素影响,强制隔离戒毒面临许多问题和困难。另外,《禁毒法》配套条例迟迟不能出台,执法部门在具体执行过程中难以准确施行。为此,笔者希望通过强制隔离戒毒的实际运行,针对实施过程中出现的问题,结合行政法中的行政行为、行政程序、行政救济等相关理论对强制隔离戒毒制度进行剖析。更多还原

【Abstract】 Compulsory isolation detoxification considered an important achievement of detoxification legislation was firstly defined in our country since "Law of the People’s Republic of China on Narcotics Control" was issued and applied on June 1,2008. It is a significant reformation that compulsory isolation detoxification broke previous anti-drug control through forced measure and labor reeducation, further completed China legislation system of anti-drug control, reflected man-based anti-drug control conception, and deprecated international social unfavourable opinion. Since the system of compulsory isolation detoxification formal applied, "Law of Narcotics Control" played an important role in helping drug user of Gansu province return society after get rid of drug addiction and reducing all kinds of harm from drug abuse. According of investigation many questions and troubles is existing owing to limitation of law-enforcing environment, absence of supervision mechanism, shortage of fund, and so on. Additional, the department of law enforcement don’t accurately implement because matched articles of "Law of Narcotics Control" isn’t published. So, on the basis of existing questions during the law being enforced the author analyzed the system of compulsory isolation detoxification by practical operation, and academic method of administrative action, administrative procedures, and administrative relief.更多还原
