【摘要】 本文立足于信息化条件下军事训练转型的实际,着眼为军事斗争准备提供法律保障,探讨了军事训练法律问题的一般理论,尝试对军事训练法律问题的基本类型进行概括分析,并从宏观上对解决军事训练法律问题提出了自己的思考。全文主要包括引言、正文、结语三个部分,其主要内容如下:第一部分引言,引言介绍了军事法学研究没有将军事训练中的军队内部、军队与地方以及涉及外军的诸多法律关系纳入研究视野,同时阐明了撰写本文的目的。第二部分正文,包括三项内容:一、军事训练法律问题的研究范畴。一是介绍了什么是军事训练以及它的分类,确定了本文研究的是部队军事训练;二是对军事训练法律问题的概念进行了界定;三是笔者对军事训练法制化、军事训练善后工作以及平时战时法律问题区分等相关问题进行了辨析;四是提出了一些与军事训练法律问题相关的理论问题。二、军事训练法律问题的基本类型。一是介绍了军队内部,军人与军人、军人与单位在军事训练中可能发生的内部性军事训练法律问题;二是介绍了军事训练过程中由于军政军民关系处理不当,造成人员伤亡、经济损失等外部性军事训练法律问题;三是联合军演往往需要他国或多国的武装力量到某一参演国境内,带来诸多与国内军事训练中不同的法律问题。三、对军事训练法律问题进行了宏观思考。笔者认为,对解决军事训练法律问题方面存在的不足尝试性地提出了四个方面的思考:第一,提出了要维护正常的军事训练秩序;要确保最佳的军事训练效益;要保障人的基本权利的实现三个解决军事训练法律问题的基本出发点。第二,提出了立法目标构建;立法权限配置;立法体例选取;具体立法构想等军事训练法律问题的立法设计。笔者认为,具体立法构想包括:军事侵权赔偿法律制度;军事征用补偿法律制度;军政军民关系法律制度;军人伤亡保险法律制度。第三,提出了行政救济方式和司法救济方式两种军事训练法律问题的救济方式。最后,提出了要健全军队法律服务机构;要加强法律服务队伍建设;要完善军队法律服务模式三个解决军事训练法律问题的服务机制。第三部分结语,对全文进行了总结,论文对军事训练法律问题研究范畴进行了明确界定,分析了与军事训练法律问题相关的军人权利义务关系、军政军民关系等理论问题。在此基础上,尝试性地将军事训练法律问题划分为三大类型和十二个具体类型,并进行了考察与分析,最后提出了解决军事训练法律问题的对策思考。更多还原

【Abstract】 The essay is comprehensively illustrated in improvement of military training under information-oriented reality, providing legal background for military battles, discussing general theory of legal issues in military training, attempting to analyze and summarize basic types of legal issues in military training, and bringing up new thoughts from a bigger view to solve them.Introduction, body part, and conclusion are included, and displayed as following:Introduction: In this part, it is stated that legal-related issues in military training hasn’t been comprehensively perfected in our military legal system, meaning that legal relations between internal of military forces, troops and civilians, and foreign forces have not been thoroughly studied. The purpose of this essay is mentioned and clarified.The body part contains three aspects:1. The range of legal issues in military training. Military training and its types are introduced, and the essay’s topic, namely troop’s military training, is determined; the concept of legal issues in military training is defined, and different terms are discriminated; some theories concerning legal issues in military training are brought up, such as military personal’s rights and obligations, relations between military and civilian, military and government administration.2. Basic types of legal issues in military training. They can be cataloged into internal, external, and in joint military exercise, according to different areas of legal issues in military training.A. Internal legal issues in military training. The legal could be violated within the troops during training progress, causing casualties and personal missing.B. External legal issues in military training. Casualties and property damages or losses could lead to disputes because of inappropriate encounters or business. Three results might be happening: local companies or personal suffer from interest losses; military facilities are damaged or training is disturbed; both sides are victims in contract disputes.C. Legal issues in military training in joint military exercise. The exercise would be jointed between two or multiple nations with their troops, and various situations could occur, such as cultural, historical, and political background differences, alien military forces entry with deadly weapons likely, jurisdiction, and damage compensations.3. Strategic thinking and possible solutions of legal issues in military training.A. Legal issues in military training should be treated based on three points. One is maintaining routine training orders, two is maximizing training efficiency, and three is guaranteeing basic human right.B. Legalization concerning legal issues in military training. Various legal systems concerning legal issues in military training should be established, such as compensation and insurance laws.C. Relieve methods concerning legal issues in military training, including administrative and judicial relieves.D. Service system in military training. Advising, supervising, and enforcement facilities should be set up to stabilize the services in military training.The conclusion put final words on the essay.
