【摘要】 众所周知,随着社会经济的发展,环境污染日趋严重。20世纪以来,世界各国采取了各种环境管理手段来环境问题。中国在探索“两型社会”的建设,即资源节约型社会、环境友好型社会。而以武汉为中心的“1+8城市圈”的联手,为“两型社会”的探索开辟了一番天地。“1+8城市圈”的建立,为湖北的经济带来了本土资源的另一高度的开发,使得原有的重工业和外商投资的发展和拓展得到了新一轮回的提高。但是,随之而来的是环境压力问题,也是当局者所不容忽视的重中之重。当前,我国提出了污染物排放总量控制的环境管理思路,其中一个有效的方法就是排污权交易制度。该制度提出于20世纪70年代,现在已经在世界范围内被广泛采用,但其仍然存在某些突出的理论和实践问题。在我国,由于排污权交易制度试行不久,特别是在“1+8城市圈”中采取其为区域排污权交易制度,实行更是比较困难,因此,对于该制度的理论和应用研究显得更为重要。本文以湖北省“1+8城市圈”建设,经济实现一体化为背景,以道德失范等理论和比较方法为研究工具,对城市圈排污权分配和交易中的若干问题进行了一些理论分析和应用研究,研究目的是针对当前排污权交易制度实行过程中存在的公平性、有效性和政策的动态一致性等方面的问题,提出一些新的解决方法和思路,对某些政策行为给出理论上的建议。本文首先系统的介绍一下“1+8城市圈”的相关概念和排污权交易制度中的相关基本概念,并结合地阐述了在“1+8城市圈”背景下,突破原有排污权交易制度规划的可行性,以及实行城市圈经济一体化实现的意义,中间或间接地夹杂了我国排污权交易制度的实行现状。最后重点分析了城市圈区域排污权交易制度实行的思路,即站在功能区角度,运用道德失范理论、市民社会理论及社会教义理论,对初始配额、总量控制和一级市场、二级市场的分配思路的分析。本文针对初始配额的分配问题中,结合现行的历史排放量分配法、热值法分配方法等分配方法的比较研究,提出了利税法分配法的较完善的方法。总量控制的方法理论中,大胆设想了运用仿真平台Netlogo计算机软件来运行总量控制的计算。但该数据是几似乎完美值,现实中的很多影响因素是不可能都设计进去的,所以,只是仅供参考的数据,而且社会变迁之快,对于该数据应制定一个周期性,每一周期就要将参与到社会环境的新的因素输入模型库中,再次计算出总量。以此类推。当涉及到区域排污权交易市场的一级市场和二级市场的分配时,本人运用了道德失范理论和市民社会理论,从根本上提倡树立市民的道德信仰,统一的信仰,使得我国的法律建设可以走回正常成长轨道上来。本文在论证的过程中,也借鉴了我国现在的排污权交易制度的现状中存在的不足,对“1+8城市圈”区域排污权交易制度的论证提供前车之鉴。更多还原

【Abstract】 As we all know, with the socio-economic development, environmental pollution has become increasingly serious. Since the 20th century, around the world to take a variety of environmental management tools to environmental problems. However, the attendant pressure on the environment, but also can not be ignored by the authorities of the most important. At present, China put forward the control of pollutants in environmental management ideas, which is an effective emissions trading system. The system proposed in the 20th century, 70’s, is now in the world that are widely used, but there are still some outstanding theoretical and practical issues. In China, due to pilot emissions trading system soon, especially in the "1 +8 city circle" for the region to take its emissions trading system is relatively more difficult, therefore, the system theory and applied research is all the more important.Based in Hubei Province‘1 +8 City Circle’building, economic integration as the background to the theories of moral anomie and comparison tool for the study of the city circle distribution and trading of emission rights in a number of issues in a number of theoretical analysis and applied research, research aimed at the implementation of the current emissions trading system in the course of the existence of the fairness, effectiveness and policy coherence in such areas as the dynamics of the problem and introduce new solutions and ideas, act on certain policies given theory proposals.In this paper, first of all, tell us about the system‘1 +8 city circle’and the related concept of emissions trading system, the relevant basic concepts, and elaborated in the light of’1 +8 City Circle’background, the breakthrough in the original emissions trading system the feasibility of planning and implementing the city circle the significance of the achievement of economic integration, the middle or indirectly, been mixed up with the implementation of China’s emissions trading system for the status quo. Focus on an analysis of the final laps of regional emissions trading system for the city to implement the idea, that is, the use of moral anomie theory, the public teachings of social theory and social theory, the initial quota of total control and the primary market, secondary market analysis of the distribution of ideas .In this paper, the initial allocation of quotas in light of the history of the current distribution of emissions, thermal value method of allocation methods of the comparative study of the distribution, the distribution of the tax law of a better law approach. The total control theory, a bold idea of using computer software simulation platform Netlogo to run the calculation of total control.
