【摘要】 由于城市规划活动的特殊性,技术标准在规划活动中起着至关重要的作用。城市规划技术标准,若从形式来判断,大部分城市规划技术标准应被排除于法律规范之列。若从实质意义上的标准来判断,技术标准是行政机关判断事实认定构成要件的根据,同时其也间接地对私人的权利义务产生了影响。在审判中,其对事实状态起着证明的作用,对行政行为是否合法有着规范的效力。法院目前在城乡规划案件中对规划技术标准的审查主要是形式上的审查。但是,由于司法工作人员审查能力的局限,以及对行政权的尊重,还有审查成本的考虑,对技术标准进行实质性审查的力度非常的弱。我国目前还无法对技术标准的制定程序进行司法审查。在司法审判中,不同类型的规划技术标准之间,规划技术标准和其他领域的标准存在着适用上的冲突,法官在选择这些标准的时候,要在尊重行政机关判断能力的前提下,从区域的特殊性、保障公民权益的角度出发来对冲突的标准进行选择,在发生技术标准冲突的时候应当以下级规划部门标准优先、旧有标准优先、较高标准、国家标准优先的冲突规则选择案件审理中所需要的技术标准。更多还原

【Abstract】 The technical standards of city planning are playing an important role in the fields of city planning. Under delegation test, publication test, external form test and procedure test, technical standards should be excluded from the group of legal norms. But if based on substantive standards, to consider whether technical standards have the legal force, it can draw the conclusion that technical standards are important basis to determine facts by administrative agencies, technical standards also indirectly prescribed the right and obligation of private persons, so it external legl effects on private persons. If legal norms should be norms used in the court, then the facts determined by technical standards should be evidence in judicial review. Though technical standards don’t have the form of legal norms, but it exerts the same function and effectsDue to the complexity of technical issues, the judges should not use their own judgments to substitute for judgments by administrative agencies. Though courts are considered as experts on procedural matters but not on substantive matters, but now in china it can’t carry out judicial review on technical standards-setting procedure. The technical standards can be classified into different types. Different standards may collide with each other, and the technical standards of city planning may collide with the technical standards in other fields. The judges can choose the reasonable technical standards in the trial. In order to protect the rights of the civics, the judges should make the choice with caution.
