法律与爱

【副题名】走出《安提戈涅》法律条文主义绝对化的悲剧

【摘要】 人们通常认为法律作为一种文明化的力量,对于爱欲的限制是必要的,因为爱反映了人类偶然、激情的本性,但是将生活完全构建于法律之下是否存在问题呢?笔者通过对戏剧《安提戈涅》的分析,认为剧中的主人公克瑞翁和安提戈涅都将自己的生活完全依赖于法律,漠视了生活中无法克服的偶然,最终铸成悲剧。这种生活方式实质上陷入了绝对化的条文主义。笔者认为,条文主义本身对法律的尊重和对确定性的孜孜以求具有正当性,但我们对法律确定性的依赖应当保持在一定的限度之内。在戏剧中提醒我们意识到这种限度的是爱的代表海蒙。法律需要爱,以此走出对确定性的盲从;爱也需要法律,避免使自己处于无休无止的纷争和混乱之中。法律与爱之间不是对立,爱实现了法律的开放。藉由爱,文章找到一个走出条文主义绝对化的路径:在愿望的指引下适时地创造性地突破法律。笔者得出结论:对待法律与爱正确的态度是尊重两者的存在,同时审慎地保持两者之间有差异的统一,实现一种自由且理性的生活。

【Abstract】 Law is seen as the civilizing force which is necessary to restrain the Eros of love, because love points to our contingency, passionate nature. But doesn’t living under the law have any questions?Through Antigone, I want to argue the main protagonists construct their lives under the law, neglecting the contingency, so in the end the tragedy happened. In fact this method pushed legalism to the extreme. In my opinion, legalism has validity because it shows the respect for the law and the desire for the certainty, but it should be controlled at a proper limit. In tragedy the question is prompted by the present of love Hamon. Law needs love to walk out of its stickiness, and love which is dangerous needs law to avoid chaos. Love and law aren’t in opposition, love makes the openness of law come true. Through love, the article finds a method of walking out of exceeding legalism, which is breaking the law properly guided by its aspiration and so the right attitude of dealing with law and love is respecting their distinguished exists and keeping them in differentiated unity in order to have a liberal and rational life.
