【摘要】 为了有效推进我国农村改革和解决三农问题,地理标志保护和农产品质量安全意义重大。我国是地理标志农产品资源丰富的国家,但是我国地理标志农产品无论是在国际市场还是国内市场屡屡出现质量安全事故,大大削弱了其国内外市场竞争力,严重破坏了我国农业产业化经营和农业发展。地理标志作为一种知识产权,代表的是产品的质量特色、品牌和生产经营者的信誉,蕴藏着巨大的经济效益,然而,取得地理标志认证的农产品并不能说就赢得了市场,因为地理标志农产品的质量和市场信誉才是地理标志的生命。本论文研究立足地理标志保护的客观必然性和地理标志农产品质量安全管理体系功能设计两个研究基点,建立了我国地理标志保护与质量安全管理并举的地理标志农产品质量安全保障模式。地理标志保护方面。本文通过比较分析欧洲代表性国家地理标志保护的基本情况,探讨了我国地理标志保护的实施现状与不足之处,提出了地理标志农产品质量安全保障目标下完善和加强我国地理标志保护的客观必然性。地理标志农产品质量安全管理体系方面。首先,本文对我国目前农产品质量安全管理体系展开系统分析,包括管理组织体系与管理支撑体系——法律法规与执法监督体系、检测检验体系、标准体系、认证体系、信息管理与服务体系的现状、不足与成因分析;据此,本文深入研究了地理标志农产品质量安全管理组织体系功能设计及管理支撑体系功能设计。其指导思想为:在重点解决目前农产品质量安全管理体系存在问题的基础之上突出对地理标志农产品进行具有针对性的功能设计。以完善和加强我国地理标志保护、保障地理标志农产品质量安全管理体系有效运行为目标,本文提出了相关对策建议。更多还原

【Abstract】 Protection of geographical indications and quality security of GI agricultural products are of great significance, for advancing rural reforms effectively and resolving issues concerning agriculture, countryside and farmers in our country. Although our country is rich in GI agricultural products resources, there are always many quality security accidents at home market or overseas market which impair very much the marketability of GI agricultural products and ruin badly the industrialization and development of agriculture. As a kind of intellect property, GI represents the brand and quality features of product and producer’s prestige, and contains huge economic benefits. However, agricultural products which acquire the authentication of GI may not win market competition, for the quality and market reputation is really GI agricultural products’lives.This paper erects a model of GI agricultural products’quality security guarantee including protection of GI and quality security management, basing on the necessity analysis of protection of GI and functional design of managerial system of GI agricultural products’quality security.With respect to protection of GI, this paper brings forward the necessity of perfecting and reinforcing protection of GI for GI agricultural products’quality security guarantee, basing on comparative analysis of the model of protection of GI in some typical European countries and studying on the implementary status quo and disadvantages of our country.About the managerial system of GI agricultural products’quality security, this paper first analyzes systematically the status quo, disadvantages and causes about the current managerial system of agricultural products’quality security, including the system of managerial organization and the managerial sustaining system—legal and regulatory and law-enforcing supervision system, detection and examining system, standards system, authentication system, information management and service system. Basing upon the analyses above, this paper then studies deeply on functional design of the system of managerial organization and the managerial sustaining system of GI agricultural products’quality security in order to mainly resolve disadvantages of the current managerial system of agricultural products’quality security and bring out functional design especially for GI agricultural products.Ultimately, this paper brings forward correlative measures and suggestions for perfecting and reinforcing protection of GI and guaranteeing effective operation of the managerial system of GI agricultural products’quality security.更多还原
