【摘要】 婚姻法中的男女平等原则明确了男女两性在婚姻家庭生活中处于平等地位,享有平等的权利,负担平等的义务。然而文本上的平等不等于实质上的平等,仅仅以男性为目标,强调妇女做与男子相同的工作、掌握一样复杂的技能、完成同样的工作,其结果是：现实生活中男女之间仍存在一定的差距,妇女权益不同程度受到侵害。社会性别平等理论的出现可以弥补以前所倡导的平等的不足,因为社会性别分析方法要求考察女性与男性面对的不同的社会现实、生活期望、经济环境等,认识到法律对两性的不同影响,才能消除在长期的社会发展中对女性的歧视,才能实现男女真正意义上的、实质上的平等。本文拟从社会性别角度审视我国《婚姻法》相关规定,分析该制度对男女两性的影响,进而提出完善立法的建议,以期为实现真正的男女平等尽绵薄之力。更多还原

【Abstract】 Equality of men and women principle in marriage law has made clear that men and women is amphoteric being on an equal footing in marriage home life, has enjoyed equal right, has born equal duty. But whether the upper tie of version waits for Yu or not in substance take the male sex as target equally, only, emphasizing that the woman does the job identical with male person, grasping the same complicated technical ability, accomplishing the same job, whose result is:Existence is still certain in the actual life between men and women gap, woman rights and interests accepts encroachment to varying degrees.
