【摘要】 当前,我国社会存在着一个不容忽视的社会弱势群体,这个群体具有经济利益的贫困性、文化素质的低水平性、生活质量的低层次性、政治参与的边缘性和心理承受能力的脆弱性等特征,它的形成与市场经济体制改革的推进、社会结构的不平衡、制度设计的不合理及自身条件的不适应等密切相关。从法律上保护弱势群体的生存权、劳动权、受教育权等各项权利,对于实现法律实质正义、促进社会和谐稳定、体现政府存在的合法性、引导社会民众相互关照等,具有重要的意义。经过多年的努力,我国弱势群体权利法律保护取得了一定的成绩,但也存在着受保护的弱势群体范围较窄、法律体系不够完善、法律法规执行不够有力等多方面的问题与不足。适应弱势群体权利法律保护的需要,我们应树立公平、良法、特殊保护以及以人为本等理念,不断健全弱势群体权利保护的基本法律体系,完善社会保障法律制度,健全促进弱势群体能力发展的法律制度和促进弱势群体权利实现的司法救助制度,同时要完善弱势群体权利保护的诉求表达法律制度。更多还原

【Abstract】 Currently, there is a social underprivileged group in China that can not be denied. People in this group have relatively low income; receive less education; have a lower standard of living; have fewer opportunities to participate in politics and have fragile metal tolerance. The development of market economy, the imbalance of the social structures the unreasonable system as well as their weak adaptability contributes to the emergence of the group. To legally protect the rights of the group including survival rights, labor rights and right to receive education has great significance of enhancing the social harmony and achieving the justice of the law.The legal protection of rights of the social underprivileged group has made certain achievements after years of efforts. However, problems exist-only part of the group is protected, the relevant law needs improvement and the law enforcement has to be strengthened. People-oriented conception should be established to further improve the basic law systems concerning the protection of rights of the group.更多还原
