【副题名】以苏北基层法院诉讼、非诉讼机制解决民事纠纷为视角

【摘要】 随着经济社会的发展,农村社会结构重构、传统规则弱化,农村社会成员发生社会地位变迁、法律意识成长。在此进程中,农村民事纠纷的解决机制出现新的变化。诉讼、非诉讼纠纷解决机制均出现不适应解决农村民事纠纷的问题。本文以苏北基层法院运用诉讼、非诉讼纠纷解决机制处理农村民事纠纷的实践为基础,针对农村民事纠纷解决机制不适应社会发展需要的问题予以阐述,并提出诉调对接和诉讼、非诉讼纠纷解决机制对接的方案和建议,以促进农村社会成员选择非诉讼纠纷解决机制的自觉性和主动性,提高法院综合运用诉讼、非诉讼纠纷解决机制解决农村民事纠纷的意识和能力。更多还原

【Abstract】 There are more and more changes about the civil dispute resolution mechanisms in rural area in the process of the changes of social statues among the rural community members and the growth of legal consciousness, with the economic and social development which reconstructs the rural society and impairs the traditional rules. Litigation or non-litigation dispute resolution mechanism is not suited to solve the issue of civil disputes between peasants. The essay which bases on the practices of dealing with civil disputes in rural areas with methods of litigation and non-litigation dispute resolution mechanisms used by the courts in the north area of Jiangsu, proposes the solution of joining between litigation and mediation and connecting between litigation dispute resolution mechanism and non-litigation’s, with clarifying the inconsistent situation between the civil dispute resolution mechanisms in rural area and the development of society, in order to promote rural community members to choose non-litigation dispute resolution mechanism initiatively and improve the awareness and ability of the courts of integrated using both litigation and non-litigation dispute resolution mechanisms to resolve civil disputes in rural areas.更多还原
