【摘要】 完善行政审批监督体系是反腐倡廉的必然要求,也是行政审批制度改革的关键环节和重要任务。为进一步推进行政审批制度改革,我们要按照党的十七大会议精神,加大改革力度,在继续深化行政审批制度改革的过程中,努力抓好完善行政审批监督体系这个重要环节,建立健全有关工作制度,用制度管人,用制度管事,真正建立起一套适应行政审批制度改革要求的行政审批监督体系,促进行政审批工作的法制化,规范化和制度化。本文着眼于建立公正、透明,协调的行政审批监督体系为目标,以行政审批监督的现状为基础,以行政审批监督理论创新为重点,从行政审批全过程中如何建立和健全内部监督和外部监督,建立健全行政审批监督系统协调机制、责任追究制度等方面进行论述,力求在认识上有所超前,在理论上有所创新,在实施过程中具有操作性。全文共分为四章:第1章主要由选题的背景和意义、国内外研究现状、研究的思路和主要内容、研究的方法及可能的创新点四个部分构成。第2章论述了完善行政审批监督体系的必要性,当前我国行政审批监督体系取得的成就,并指出我国行政审批监督体系存在行政审批监督意识不强、行政审批监督制度匮乏、行政审批监督渠道不畅、行政审批监督方式和方法欠科学、行政审批内外监督协调机制不健全等问题。第3章着重对完善行政审批监督体系的指导思想、基本原则和总体要求进行了阐述。指出完善行政审批监督体系必须坚持法制性原则、公开性原则、民主性原则、审监分离原则、监督回避原则。完善行政审批监督体系的总体要求有:明确行政审批监督主客体责任、合理配置行政审批监督权力、科学制定行政审批监督程序。第4章则从完善内部监督体系,完善外部监督体系、建立行政审批监督体系的协调机制、建立行政审批与监督的责任追究制度、加强行政审批监督的法律保障机制、提高行政审批监督的现代化水平等六个方面探讨了完善我国行政审批监督体系的具体对策。更多还原

【Abstract】 Perfecting the supervision of the system of administrative approval is a necessary requirement for anti-corruption, reform of administrative examination and approval system is the key and important task. In order to forward the reform of administrative approval system, we should intensified the reforms in the Continue to deepen reform of administrative examination and approval system, improve the supervision system of administrative approval of this important aspect relating to the establishment of a sound system, personnel system, a system manager, to establish a set of administrative examination and approval system to adapt to the requirements of the administrative reform Supervision of examination and approval system, and promote the work of the administrative examination and approval of the legal system, standardization and institutionalization.This article focuses on the establishment of a fair, transparent and co-ordination of supervision of the administrative approval system as the goal, to oversee the administrative approval based on the current situation, the administrative approval in order to focus on innovative supervise theory, the administrative approval from the entire process of how to establish and improve the internal supervision and external supervision and improve the supervision of the administrative approval system coordination mechanisms, accountability systems for paper, trying to be understanding in advance, some theoretical innovation in the implementation process operational. This paper consists of four parts:The first part, a brief introduction to the origin of the selective topic, and then put forward the research fragment, methods, creativities on the basis of analyzing the background, significance of the selective topic, evaluating the research achievement of the supervision of the administrative approval system at home and in abroad.The second part, mainly discusses the necessity of improving the supervision of the administrative approval system, noting that China’s supervision of the administrative approval system, the existence of the administrative approval is not strong sense of supervision, lack of administrative examination and approval system, and supervision of the administrative examination and approval channels do not Chang, the cost of supervision the administrative approval is expensive.The third part describe the general requirements, guiding principles and concrete of the improving the supervision system of administrative approval. Pointed out that improving the supervision of the administrative approval system must adhere to the principle of the rule of law, the principle of openness, the principle of democratic, the principle of separation of pre-trial prison, the principle of avoiding supervision.The last part analyzes the Solution to the Problem of Supervision System of the Current Administrative Approval from the internal supervision system and the external oversight system; establish a supervision system of administrative approval of the coordination mechanism, the establishment of the administrative approval and oversight of the accountability system, strengthen the supervision of the administrative approval of the legal protection mechanisms, the establishment of the administrative approval on-line monitoring system to enhance supervision of modernization.更多还原
