中国公共住房的“内循环”机制研究

【摘要】 住房问题不仅是重要的社会民生问题,同时也是重要的经济问题。由于中国住房体制改革,出现了少部分经济困难家庭无力购房、租房困难的情况。为了改善人民的居住环境,特别是改善低收入家庭的住房困难,我国政府出台了一系列政策,目前我国公共住房主要包括经济适用房、廉租房、公共租赁房等。公共住房的资源有限,如果出现持有人为了短期套利骗取住房或者不符合条件的居民长期占用资源,就无法循环使用,无法切实保障低收入人民的居住权利。因此,为了使公共住房政策兼顾效率与公平,保证公共住房的可持续发展,建立一套内循环机制是亟待解决的问题。鉴于此,本文涉及了公共住房内循环的模式如下:(1)出售型、租售并举型公共住房的内循环,将出售型及租售并举型公共住房统一管理,采取先租后售的方式,公共住房居住到一定年限后,可以有优先购买的权利,通过设置最低保有年限,在此年限内,若业主出售公共住房,则只能由政府进行回购,杜绝出售型、租售并举型公共住房的外循环。存量出售型、租售并举型公共住房设置最低保有年限、上市保有年限、最长保有年限。根据购房人持有年限的长短制定相应的出售限制。一般来说,持有年限越长,业主出售公共住房的限制越少,持有年限越短,限制越多。增量出售型、租售并举型公共住房统一实行租售并举,在最低持有期限内,居民只能与政府签订公共住房的租赁合同,将租赁期限、租赁合同届时转为出售合同的条件、相应的权利义务体现在租赁合同中。当居民居住在公共住房达到了最低保有年限后,家庭可以申请购买租住的公共住房。同存量住房的处理方式类似,增量住房的持有年限也划分为最低保有年限、上市保有年限、最长保有年限,与存量住房的政策不同,增量公共住房在最低保有年限居民与政府先签订租赁合同,后签订出售合同,只有通过了最低保有年限,家庭才有资格申请将租赁合同转为出售合同,这个变化是为了保护公共住房的产权内循环;(2)租赁型公共住房的内循环机制包括租金梯度控制,最高租赁期和租房券等内容。其中租金梯度控制是指随着租住年份的增加,租金也相应增加,最后租金也许等于或者超过市场租金。
【Abstract】 Housing problem is not only an important economic problem, but also an important social problem. A few low-income families can not buy housing because of China’s housing system reform. In order to improve the living conditions of residents, especially solve the housing problem in low-income family, government adopted a series of policies, such as affordable housing and low-cost housing policy, housing accumulation fund system, but the effect is unsatisfactory. Holders occupying house for short-term arbitrage and residents not meeting the conditions occupying house for long time cause the public housing can’t recycle and government can’t ensure low-income resident’s living rights. In order to enable the public housing policy is sustainable developing and the public housing is efficient and fair, the paper involves the mode of "inner cycle" institution of public housing:(1) Public housing for sell and rent will be unified management. After living in the public housing for a certain years, the family can sell public housing. In the minimum keeping years, if owner sell public housing, he must sell to government, which eliminate public housing "out cycle".Stock public housing for selling and rent set minimum keeping period, selling keeping period and longest keeping period. Government formulates policies according to the period of the keeping public housing. Generally speaking, the period of buyers keeping the public housing is longer, buyers have more independent right, the period of buyers keeping the public housing is shorter, buyers have less independent right.Incremental public housing can be rent also can be sold. Government and residents who buy the public housing sign the lease contract including lease term, property right proportion, corresponding rights and duties. According to the period of family keeping housing, the distribution proportion and processing mode are different. In a similar way, incremental public housing set minimum keeping period, selling keeping period and longest keeping period. Compared to stock house, in minimum keeping period, the public housing is for rent, not for sell. Family keeping the housing through the minimum keeping period is eligible to apply for buy the public housing. This change is in order to protect the public housing property and identify low-income families.(4) The "inner cycle" institution public housing for rent include rent control, longest rent period and rent vouchers etc. Rent control refers to as the increase of the years, rent rises accordingly, and finally the rent is equal to or more than market rent.
