【摘要】 质量,关系着百姓生活的衣食住行、关系着每个企业的生存和发展、关系着社会稳定和国家形象。质量技术监督局作为保证质量安全的政府职能部门,也越来越多地受到公众的关注,质量技术监督执法作为保障质量安全的重要手段,近些年虽然取得了很大的成绩,但是还存在着诸多问题,重大的质量事故时有发生,导致质量技监执法的公信力在一定程度上受到公众质疑。上海是我国的经济中心,质量技术监督部门为市场经济健康发展提供了重要的保障,这些年执法建设取得了较明显的进步,已建立了较为完善的体系,但依然存在着执法不严、执法人员法制意识不强、执法监管不力等问题,研究如何完善质监行政执法对提高执法效率、促进上海市经济发展有着重要的现实意义。本文从当前上海市质量技监行政执法存在的主要问题入手,以行政法学、公共管理等理论为指导,从法规建设和行政管理两方面分析了产生上海市质量技术监督行政执法问题的原因。在法规建设方面,立法不完善、体制建设不合理和执法监督不到位是造成该问题的主要法制基础方面的原因;行政管理方面,人员素质不高、管理制度不健全都是影响执法水平的重要原因。根据产生执法问题的各方面原因,再对比国外一些发达国家有关质量技术监督行政执法方面的先进经验,从如何完善法规建设,加强执法监督和提高执法管理水平,加强执法队伍建设等方面提出了完善上海质量技术监督行政执法的对策建议。更多还原

【Abstract】 The quality is of vital importance to common people’s life, the existence and development of every enterprise, and social stability and the image of a country. The Municipal bureau of quality and technical supervision(MBQTS), as a government functional department, is getting more and more public attention. The administrative law enforcement of quality and technical supervision authorities, as an important measure to ensure quality safety, has made great progress in recent years, but there are still various problems. Major quality incidents happened from time to time, and to some extent, the credibility of the law enforcement of quality and technical supervision has been questioned by the public.Shanghai is the economic center of China. Shanghai Municipal Bureau of Quality and Technical Supervision ensures the market economy developing positively. In recent years, it has made significant progress in executing the law and has constituted a comparatively comprehensive system. However, there still exist some problems, such as the lax implementation of laws and weak law consciousness. Studying on how to improve the administrative law enforcement of quality and technical supervision will promote the improvement of efficiency of law enforcement and the development of the economy in shanghai in a real sense.Starting with the major problems of the administrative law enforcement of quality and technical supervision authorities in Shanghai, this paper is to analyze the causes from the perspective of the construction of laws and the administration, with the guidance of the theories of administrative jurisprudence and public administration. With respect to the construction of laws, it is the immature legislation, unreasonable system construction and imperfect supervisory system that mainly causes such problems. As far as the administration is concerned, officials’bad professional qualification and the deficiency of the administrative system, both affect the level of law enforcement.Based on the reasons of law enforcement problems, and compared with developed countries’advanced experiences, this paper proposes the countermeasures and suggestions on how to perfect administrative law enforcement of quality and technical supervision authorities in Shanghai, such as how to perfect laws and regulations, reinforcing law enforcement supervision and upgrading the level of administrative law enforcement, as well as strengthening the construction of law enforcement team.更多还原
