【摘要】 在改革开放日益深入,对外交流逐渐扩大的过程中,中国的经济得到了迅速发展。但在发展经济的过程中,影响经济良性发展的因素也与日俱增,尤其是利用合同进行的诈骗犯罪活动,呈现增加的趋势,表现出专业化,职业化的特点。为预防和打击合同诈骗罪,扫清社会主义现代化建设的障碍,必须对合同诈骗罪进行深入广泛的研究。本文从合同诈骗罪中合同的分析、犯罪构成、司法认定等几个方面入手,分析合同诈骗罪产生的原因、特点,提出预防、打击、立法完善等几个方面的建议。一方面为司法实践提供理论上的支持,另一方面为打击合同诈骗罪献计献策,从而规范经济行为,净化经济环境。本文除引言和结语外,主要从六个方面入手,论述了合同诈骗罪的渊源、构成、司法认定,提出一些立法完善的拙见。第一部分:我国合同诈骗罪概述。本部分主要阐述了合同诈骗罪的概念和我国合同诈骗罪的历史沿革。第二部分:我国合同诈骗罪的犯罪构成。本部分主要介绍了合同诈骗罪的客体、合同诈骗罪的客观方面、合同诈骗罪的主体和合同诈骗罪的主观方面。第三部分:合同诈骗罪的司法认定问题。本部分主要论述了合同诈骗罪与非罪的界限、合同诈骗罪与近似罪的界限、合同诈骗罪的犯罪停止形态、合同诈骗罪的罪数形态和合同诈骗罪中的共同犯罪。第四部分:合同诈骗罪的刑事责任。本部分主要论述了重视合同诈骗罪中犯罪数额的作用和合同诈骗罪的严重情节问题。第五部分:中外合同诈骗罪立法模式及内容之比较。本部分主要论述了国外合同诈骗罪的立法模式及内容和我国合同诈骗罪的立法模式及内容。第六部分:我国合同诈骗罪的立法缺陷及其完善。本部分主要介绍了我国合同诈骗罪的立法缺陷和我国合同诈骗罪的立法完善。更多还原

【Abstract】 Because of the reform and opening up, the process of gradually expanding foreign exchanges and China’s economy has developed rapidly. However, the process of economic development, factors that affect economic development has become began. especially the use of contract fraud and criminal activities, showing an increasing trend, showing professionalism, professional features. Contract to prevent and combat fraud, clearing the obstacles of socialist modernization, contract fraud must be extensively studied in depth.
