我国宪政实现的路径选择

【摘要】 我国现在处于一个利益矛盾冲突多发期,这是与我国经济不断发展,政治改革不断深入息息相关的。为了建设一个具有中国特色的社会主义宪政国家,我国现行的政府推进型宪政实现路径,不可否认,从新中国建立以来60多年的宪政实践探索过程中,这种宪政实现路径功不可没,在宪政思想启蒙和宪政制度总体构建等方面发挥了重要的作用。但是,在市场经济不断发展的今天,社会利益不断分化,利益主体的民主权利意识不断增强的现实环境下,该宪政实现路径越来越显出其固有的不足之处,基于此本文提出对政府推进型的宪政实现路径予以完善,主张向合作型的宪政实现路径过渡。判断一种宪政实现路径的适应性,首先要看它是不是能够充分发挥宪政构成四要素(宪法,民主,法治,人权)的积极作用,能够促进宪政四要素的发展与不断完善。本文从宪政理念入手,分析了合作式的宪政实现路径与目前我国国情的适应性和优越性,特别是在国家-利益团体-公民三元主体间的相互关系中所发挥的积极作用,并从理论和实践角度对如何构建合作型的宪政模式的提出从表达与沟通机制,竞争与博弈机制,妥协与合作机制三个方面构建其存在的社会环境,并结合我国人大制度,政协制度,社会团体的发展实践中以及民主,法治,人权的理论实践中发挥合作式宪政实现路径的积极作用。更多还原

【Abstract】 China is now in a period of multiple conflicts of the interests, this is closely related to the continuous development of China’s economic and deepening political reform. In order to build a socialism constitutional state with Chinese characteristics, our current model is the realization path of constitutional government in promoting. It is undeniable that since the founding of New China 60 years of constitutional practice and exploration process, the realization path of such a constitutional contributed, in the enlightenment of constitutional thought and the whole building system of constitutional has played an important role. However, in today’s realities of environment--- growing market economy and social benefits continue to divide and the democratic rights awareness is growing, that the constitutional path has achieved more and more its obvious inherent shortcomings, in this paper based on the realization path of constitutional in type of government in promoting I want to be perfect, to transit the cooperative’s realization path of constitutional. The determination of a realization path of constitutional adaptability, first of all it should be able to give full play to the constitutional constitute four elements (the constitution, democracy, rule of law, human rights),should to promote the four elements of the constitutional development and continuous improvement. This paper starts from the constitutional analysis of adaptability and superiority between the cooperative’s constitutional path and the current condition of our country, especially in country-interest groups-civil ternary relationship in the positive role played by, and from theoretical and practical point of view, I want to discuss how to build a cooperative constitutional model and propose expression and communication mechanism, competition and game mechanism, compromise and cooperation mechanism in this three areas to build its social environment, combined with the development and practice in China’s National People’s Congress system and the Political consultation systems, social organizations, as well as the theory and practice of democracy, the rule of law, human rights at the end, I discuss that cooperative’s constitutional path plays a positive role in the path of constitutional implementation in our country.更多还原
