【摘要】 重大事项决定权是人大的基础权力,但相关法律规定过于原则,难以具体操作；由于种种原因,全国人大至今也未能研究出台相关办法,只能期冀于省级以下地方人大的探索实践。多年来,各地人大在这方面做了不少尝试和实践,几乎所有地级市以上的地方人大都出台了关于重大事项决定方面的规定,或多或少也作了一些决议、决定,但是地方重大事项基本由党委、政府决定的状况没有根本改变,地方人大远离本地区重大事项决定权力中心的状况没有根本改变。人大在大多数人眼中仍是只能建言献策,根本不能作出什么有现实影响的决定,还远不是真正的权力机关。人民代表大会制度已经实践了五十多年,地方人大设立常委会也已经三十多年。从履行法律赋予人大的职权出发,从越来越多的公民对民主的期盼出发,是该到了突破困境的时候了!本文溯本求源,从法律授予人大重大事项决定权的规定出发,以法社会学的视角,立足于我国国情和实际,对地方人大重大事项决定权的概念、特征、与人大其他权力的关系进行研究。结合实际,对当前重大事项决定权的行使现状、存在不足及原因进行分析,对突破困境进行原则思考,提出改革路径,并对具体操作问题进行深入思考。在寻求突破困境、依法行使职权的同时,强调重视政治改革的安全,以增量民主来逐步增加公民的民主权利,进而逐步实现人民当家作主的努力目标。更多还原

【Abstract】 Authority of major issue is the basic power of the people’s congress, due to the relational law regulations are over principle, this power has difficult to operate:for a variety of reasons, the national people’s congress has not drawn up suitable regulations to operate this power. It has to rest it’s hope in exploration of provincial local people’s congresses. Over many years, Each of the local People’s Congress has done a lot in this attempt and practice, almost all of the local People’s Congresses on and above the prefecture-level city had promulgated relevant regulations about authority of major issues, more or less, they made some resolutions and decisions on this matter, but the situation that the local major issues had been decided by local party committees and government has not change, and the situation that the local People’s Congress is far away local power center of making decision on major issues has not change. In most people’s minds, local People’s Congress only have the function on offering advice and suggestions, instead of making decisions with real influence. It is still not the real authority.The system of people’s congress has been implemented more than fifty years, and the system of establishing standing committee by local people’s congress has been implemented more than thirty years. In order to better perform the duty under the law, to meet the expectations of democracy by citizens. It is the time to break through those difficulties! This article state at the explosion of the reason why the authority of major issues has been authorized to the people’s congress, and from the perspective of sociology of law, based on the actual situation of China’s national conditions, study the concept、meaning、features of the authority of major issue of local people’s congress, and compare this authority of major issues with other powers of local people’s congress, and combined with practical examples, to point out the real difficulties、shortages and reasons of authority of major issues,and explore the ways to solve problems, propose the reform program, and deeply think the ways on using authority of major issues. At the same time, the security of political reform must be noticed, in order to achieve the objects that the Chinese people become their own master step by step.更多还原
