【摘要】 我国的海外投资在改革开放之后取得了迅速的发展,海外投资成为国家对外开放的重要形式。尤其党的十六大提出实施“走出去”战略,鼓励有比较优势的各种所有制企业对外投资,我国的海外投资事业的发展又迈上了新台阶。在海外投资事业取得可喜成绩的同时,我们也不能忽视种种政治风险对我国的海外投资的危胁,尽管国家已经与许多国家签订了双边投资保护协定,但目前国内缺乏与之相配套的国内法,因而条约对海外投资的保护也是有限的。因而,建立海外投资保险制度,维护国家海外经济安全和海外投资者的合法权利,势在必行。本文在论述中以海外投资的基本概念和原理为基点,比较分析各国海外投资保险制度的异同,进而探究建立我国海外投资立法的借鉴依据,提出立法建议。围绕这些内容,本文分三部分展开了论述。第一章,对海外投资保险制度基本知识的介绍。本文以层层递进的方式先介绍了海外投资保险制度的概念、特征、原理、意义,进而引出了对我国海外投资保险制度的现状以及建立海外投资保险制度的原因、必要性、可行性的论述。第二章,对各国海外投资保险制度的比较分析。通过对各国海外投资保险制度的发展历史、以及制度模式、承保机构、承保条件、承保险种的比较分析,得出海外投资保险的异同优缺,为我国海外投资保险的制度的建立提供值得借鉴的立法依据。第三章,构建我国海外投资保险的制度的具体设想。根据我国具体的国情,论述我国的海外投资保险制度应采纳何种模式、如何设立承保机构、承保条件应如何规定、承包险种如何界定,提出了相关立法建议。更多还原

【Abstract】 Since the beginning of the Reform the overseas investment of our country develops fast , Overseas investment has become main form of opening to the outside of the world .In particular , "walks the strategy " was proposed in the party’s 16 representative assembly, which encouraging the superiority enterprise investment the overseas. Our country’s overseas investment enterprise development has step the new stair .while the overseas investment enterprise obtains the encouraging result ,we can not neglect all the harm , which come from all sort of political risk .our country has singed the bilateral treaty of protecting investment with many countries ,but at present our country lacks necessary national law. So the treaty to the overseas investment protection also is limited. Establishing the overseas investment protection which maintenance our country’s overseas economic security and overseas investor’s lawful right is imperative.The article was elaborating the overseas investment system basic conception and the principle. We compare and analysis various differences. Research basis of overseas investment insurance system .We put forward the legislation proposal. Revolving this content the article was divided three parts to launch the elaboration.First chapter, introduce overseas investment insurance system elementary knowledge, First introduce overseas investment insurance system concept, the characteristic, the principle, the significance .Second introduce our country overseas investment insurance system present situation as well as setting up the system’s reason, necessity, feasibility.In the second chapter we compared and analysis various countries overseas investment insurance system. We compare and analysis various countries’ development history of overseas investment insurances system, as well as system pattern, and the insurance organization, the insurance condition and the insurance type, obtain the overseas investment insurance merit and the shortcoming.In the third chapter we construct tentative plan of our country overseas investment insurance system, According to our country concrete national condition.
