【摘要】 反垄断法作为市场经济国家的经济宪法,对社会经济自由、公平和有效竞争秩序的建立以及国民经济的协调和有序发展都发挥了极其重要的作用。而反垄断法适用除外制度作为反垄断法的一项基本制度,在处理规模与效率、垄断与竞争的关系中凸现出不可替代的积极作用。我国反垄断法在社会各界的千呼万唤中,终于在2007年8月出台,其中对滥用市场支配地位、垄断协议和经营者集中等方面的规定体现了我国反垄断立法规制的主要内容,但反垄断法对于适用除外制度的规定尚不完善,仅仅是对个别经营者集中类型进行了规定,辅之以笼统地对于知识产权等特殊行业的适用除外规定,完善中国的反垄断法适用除外制度已经显得越来越迫切。本文试图通过对反垄断法适用除外制度的概念、特征、功能等基本理论分析,从经济基础、政策基础、法学基础三方面阐述反垄断法适用除外制度生成的合理性,在比较世界各国反垄断法适用除外制度的基础上,对我国反垄断法适用除外制度的现实因素和立法背景进行考证,并在对我国反垄断法充分研读的基础上,将散见于各个章节关于各个行业反垄断法适用除外的规定一一进行归纳、总结,并提出了自己的分析意见,以此为基础,结合我国的现实语境,对完善我国的反垄断法适用除外制度提出了合理化的构想。更多还原

【Abstract】 As the ecnomic constitution of market ecnomy countries, anti-monopoly law plays anextremely important role in the construction of social freedom, justice and effectivecompection system and the Coordination and development of national ecnomy. And as abasic systerm of anti-monopoly law, the exception anti-monopoly law also has positive effecton dealing with scale and benefit, monopolization and competion. China passedanti-monopoly law in august 2007 during the anticipation of the public. The prescription ofthe abuse of market domination, the monopoly agreement and the concentration of propretorsis main part of the anti-monopoly law. But the system of the exception of anti-monopoly lawis imperfect for there are only some general about some particular industries like intellectualproperty. Consummated the system of the exception of anti-monopoly law to be suitablealready appeared more and more urgent. The paper first elaborated the system of theexception of anti-monopoly law`s concept, the characteristic, the value orientation as well asthe confirmation principle and so on elementary theory. to expound the rationality of it fromthe aspects of ecnomic basic, policy basic, and law basic, to do textual reserch about therealist factor and legislation background on the basic of the comparison of different countries’anti-monopoly law, And in reads fully to our country antimonopoly law in foundation, Willsee here and there in each chapter about the exception about each profession antimonopolylaw,and carry on the induction, the summary one by one, take this as the foundation,unifiesour country’s realistic linguistic environment,finally to give some advises on the improvementof our countries’anti-monopoly law.更多还原
