【摘要】 石羊河流域位于甘肃境内黄河以西的河西地区东部,是干旱内陆河区人口密度最大、水资源供需矛盾最为突出、水污染最为严重的内陆流域之一。近年来,随着石羊河流域经济的不断发展和城镇化趋势的加大,流域地区污水排放量逐年增加,导致流域水质严重下降,生态环境严重恶化,已威胁到社会经济的可持续发展,引起国家领导人和公众的广泛关注。虽然国家和地方对石羊河流域的水污染问题十分重视,并采取了一系列治理措施,但石羊河流域水环境不断恶化,水污染形势依然严峻。本文通过对石羊河流域水污染的现状、成因进行分析,寻找防治石羊河流域水污染的法律方法,提出治理对策。第一部分,石羊河流域概况。论述了石羊河流域的自然概况、社会经济状况,对流域有了一个整体性认识。第二部分,排污权交易制度概述。分析了排污权的法律性质和排污权交易制度的法律基础,以及该制度在国外的发展和主要作用,得出在流域进行排污权交易是一项既不制约经济发展又保护流域水环境的有效的环境治理措施。第三部分,石羊河流域实施排污权交易的必要性和可能性分析。结合石羊河流域现行水污染控制政策及不足,以我国进行的水污染物排污权交易的成功实践为题,指出石羊河流域具有建立排污权交易制度的现实基础和前提。第四部分,石羊河流域排污权交易制度构建。在前面分析的基础上,结合石羊河流域的实际情况,对石羊河流域的排污权交易制度大胆构想,提出流域构建排污权交易的具体框架,使得这一先进的环境管理手段能更好的服务于石羊河流域的经济发展和环境保护。更多还原

【Abstract】 ShiYang River Basin lies in the eastern part of Hexi district to the west of Yellow River in Gansu Province, It’s one of districts having large population and some serious problems in the water resource supplies and water pollution Recently, with the rapid development of the economy and the urbanlization of the ShiYang River, the emission of the polluted water is increasing greatly in the basin. The quality of the water is decreasing year by year. The eco-system is becoming more and more serious, it threats the Sustainable development of the district. The leaders of our country and the public show great attention to the problem. Although the country and the local government have taken some measures to deal with the problem, the condition is continually becoming worse and worse. The paper made an attentive analysis to the pollution of the ShiYang River Basin in its condition and causes, the paper stated some effective solutions from the legal aspects to solve the problem.The 1st part introduces the general knowledge to the ShiYang River Basin including some natural and social information, it gives us a total recognition to the ShiYang River Basin.The 2nd part is about an overview of the marketable pollution permits system is given. Based on the analysis of the legal nature of pollution permits and the legal basis of the marketable pollution permits system, as well as the development and major role of the system in foreign countries, we come to the conclusion that the marketable pollution permits will be a good measure of water environment protection and effective environmental governance in ShiYang River Basin, without any restriction of economic development.The 3rd part analyzes the necessity and feasibility of marketable pollution permits system. To think about the shortage of the controlling measures of the ShiYang River Basin, taking the successful experimental units in the marketable pollution permits system of our country as examples, this part points out the foundations and preconditions that the ShiYang River Basin establishes the marketable pollution permits system.The 4th part writes about the building of the marketable pollution permits system to the ShiYang River Basin. With the study foundation in the former parts and the condition of the ShiYang River Basin. The writer made a bold combination in the marketable pollution permits system to the ShiYang River Basin and presented the framework in building the marketable pollution permits system to the ShiYang River Basin to make this advanced managing method serve for the economy development and environment protection much better in the ShiYang River Basin.更多还原
