【摘要】 邮政储蓄自1986年恢复开办以来,经过20多年的发展,虽已建成覆盖城乡网点面最广、交易额最多的个人金融服务网络,但是由于其长期的“只存不贷”经营方式的制约,不仅使农村资金得不到合理利用,而且导致其抵抗市场风险的能力极弱,成为了中央财政的沉重负担。为了解决这些问题,邮政储蓄的体制改革势在必行。2006年12月31日,经国务院同意,中国银监会正式批准中国邮政储蓄银行开业,同意由中国邮政集团公司以全资方式出资组建“中国邮政储蓄银行有限责任公司”。自此,全国各省、市、自治区邮政储蓄银行陆续挂牌运营。2008年3月,甘肃省白银市邮政储蓄银行正式成立。作为一个正处于新旧模式交替阶段的企业,在其运营过程中,不免受到原有经营模式的影响,因而存在着许多不合规甚至是违规操作的问题。这些问题不仅严重影响了邮政储蓄银行的健康、快速发展,而且有违法治社会的建设理念,亟待解决和完善。因此,本文作者对甘肃省白银市邮政储蓄银行进行了大量细致调研,针对实际存在的诸多违法违规问题,提出了相关的建议,希望能够起到一定的借鉴作用。全文共分为四个部分:第一部分,我国邮政储蓄银行的基本概况。主要介绍了我国邮政储蓄银行的发展历程、设立原因及组织架构,对我国邮政储蓄银行进行简单介绍。第二部分,甘肃省白银市邮政储蓄银行现状调查。为了解白银市邮政储蓄银行所存在的违法违规情况,以《中资商业银行许可实施办法》为依据,对其从业人员构成情况,安全设施配置情况,管理权益分配情况等方面进行详细介绍说明。第三部分,甘肃省白银市邮政储蓄银行现存法律问题分析。以第二部分的调查数据为基础,分析和总结白银市邮政储蓄银行在实际经营中所存在的违法违规问题。主要包括从业人员法律专业基础薄弱,部分高管人员资格违规,监管法规的不适应性,违规经营行为比较普遍等方面。第四部分,邮政储蓄银行发展的对策和建议。通过第三部分对白银市邮政储蓄银行现存法律问题的分析,结合其它商业银行的成功经验,有针对性地提出几点如何促进邮政储蓄银行依法合规经营的建议和对策。更多还原
