【摘要】 价格决策听证制度是公共决策民主化新机制的重要体现形式之一。它在我国的兴起是基于公民参与行政决策程度的提高和我国民主法制历程不断发展的基础上的。这一制度的广泛应用和实行就是为了要扩大公民参与与政府决策的范围和程度,为了加强政府价格决策行为的公开性与科学性。为此《中华人民共和国价格法》规定:政府在制定重要的和涉及国计民生的商品价格时要召开价格听证会,广泛听取社会意见,以此提高政府定价的质量。价格听证制度的确立,适应了现代行政民主化与公开化的要求,标志着我国行政行为正在向公开、公平、公正、民主的方向发展。实践中,价格听证虽然积累了一定的成功经验,但依然存在许多亟待解决的制度弊端。本文主要介绍了我国价格听证制度的内容、发展历史,分析了我国实施价格听证制度的重要意义等;并结合价格听证实践的情况,比较深入地探讨了我国价格决策听证制度存在的主要问题及原因;最后根据现有的法律法规,结合我国价格听证的具体实践情况,以建立普遍适用的价格听证制度为目的,对完善我国价格听证制度提出了几点建议。更多还原

【Abstract】 The price hearing system is public democratization of decision-making new mechanism manifests one of importantly forms. In our country it is based on the emergence of citizen participation in administrative decision-making and the continuous development of the level of China’s democracy and legal system process. This system is widely used and implemented in order to expand citizen participation in government decision-making and improve citizen participation in the decision-making process of government price. In order to guarantee the procedure of making price policy is open and scientific, the hearing system is fixed in our country’s“price law”. It requires that the government hold the hearing, pool the wisdom of the masses, before making a price for the goods, which are playing important roles in daily lives. The establishment of the hearing system has met modern administrative democratization and demanded for coming into the openness, also indicates the administrative behaviors of our country being developed into the openness, justice, fairness and democracy direction. At last, although the price hearing has accumulated some successful experience, still there are many system problems to solve.The paper has introduced and analyzed the historical origin and main contents of the hearing system, price hearing developing history in our country, questions of development and reasons analysis hearing of system. And combining the concrete practice situation of price hearing of our country, thoroughly discuss the main problems and reasons in our hearing procedure of the price decision-making. Finally according to existing provision, regarding setting up generally practical hearing systems as object, I have put forward several suggestions on the suitable current situation of the hearing system of price in our country.更多还原
