【摘要】 信息时代的浪潮正席卷着我们每一个人的生活,改变着我们的生活方式,也改变着彼此之间的联系。各种网络在拉近世界距离的同时,也带来了表达自由的革命。在这个知识爆炸、疯狂叫嚣权利的时代,人类已经不满足于“我不同意你的观点,但我誓死捍卫你说话的权利”,人类在各种网络的连接下,正在寻求一种崭新的表达方式,要求更加平等化、多元化、民主化、自我化的表达自由。传统的表达自由理论在先进的传播渠道、崭新的表达方式面前已经不能很好地继续引导我们前进的方向,表达自由更不应该仅仅是停留在“纸上的权利”。本文第一部分首先对表达自由的内涵、特征作了释义,在经过对自由的论证、传统理论中对表达自由内涵及外延的界定之后,又对表达自由的属性作了概括。之后对信息时代下表达自由表现出的新特征以及信息时代下表达自由的价值作了详细阐述。第二部分对表达自由的时代进程作了梳理,分为萌芽、确立与初步发展以及蓬勃发展三个阶段,详细叙述了表达自由的发展历史。文章第三部分从两个案例和一种现象着手,分析了信息时代下表达方式与手段的变化、法律规定的茫然、与其他权利的冲突以及全球化带来的挑战。文章第四部分是关于表达自由的实现,分别从限制和保障两方面入手,先对表达自由的限制依据和相关界线进行探讨,进而从法律保障、行政保障、技术保障和行业自律三个不同角度进行了剖析,以期能使表达自由的保障路径更趋清晰化。文章的最后一部分是对表达自由发展前景的展望,我们坚信在不久的将来,对表达自由的保护将更加的规范,作为一项权利,它离我们将越来越近。表达自由是我们最应珍视的基本权利,其深厚的文化内涵和亘古不变的人文情怀是我们孜孜追求的永恒价值。文章力求能使这种追求贯穿于始终,更期盼表达自由能引起人们更多的重视。更多还原

【Abstract】 Nowadays, we are staying in a day by day developed information society which changes our life style and makes man contact each other more easily. Various network pulls closer the man distance also has brought the expression freedom revolution. Man aren’t, in the modern information society that knowledge develops fast and people advocates the right loudly, satisfied with "I do not agree with your viewpoint, but I pledge to fight to the death the right which guards you to speak" but looking for a new kind of expression freedom which is more equal, more multi-dimensional, more democratic and more independent because expression freedom is not a kind of right written only on the paper and traditional expression freedom theory can not go far away in then new dissemination way and new expression style.The essay is made of five parts. In the first part, after introducing the definition of free and the connotation and extension of expression freedom, the essay elaborates mainly the new character and significance of expression in the information society. The second part made a carding of expression freedom’s time advancement, divided into budding, as well as the establishment and initial development to flourish in three stages, described in detail the historical development of freedom of expression. The third part of the article starts at the two cases and a phenomenon, and analyses the changes of the means to express, the law at a loss, conflict with other rights, as well as the challenges posed by globalization.. The fourth part is on the research of how to make expression freedom true. In this part, firstly the essay elaborates the limit of expression freedom and then analyzes the protection of expression freedom and gives four kinds of protection ways, legislation, executive protection, technical support and profession autonomy. The last part of the article is a promising outlook, we firmly believe that in the near future, the protection of freedom of expression will be more standardized, as a right, it will be getting more and more closer from us.We should cherish the expression freedom because it is a kind of basic right indicating deep cultural connotation and eternal humanities mood.
