【摘要】 工程建设涉及千家万户的生命和财产安全,乃百年之大计。改革开放以来,对国家经济发展和社会进步的贡献不言而喻。建筑业的有序发展,直接影响国民经济健康有序的发展。到目前为止,我国已在建筑行业建立了比较健全的建筑合同法律、法规的管理体系,已经形成了以《建筑法》、《招标投标法》、《合同法》为三大支柱,以《建设工程质量管理条例》、《建设工程安全生产管理条例》、《建设项目环境保护管理条例》及地方性法规、部门规章、规范性文件为辅的建筑法律体系基本框架。但由于建设工程施工过程本身的错综复杂,涉及到的新问题、新情况层出不穷,尤其是如何认定无效的建设工程施工合同及其处理方式成为理论界和实务界备受争议的问题。本文针对此问题,对建设工程施工合同的无效的特殊性进行讨论,对其中比较有争议的,可能导致建设工程施工合同无效的情行进行系统论述。本文分为三章,第一章建设工程施工合同的效力概说,从建设工程合同的定义出发,阐明其与一般合同所不同的特征,结合最高人民法院下发的《关于审理建设工程施工合同案件纠纷适用法律问题的解释》阐明认定无效建设工程施工合同的一般原则。第二章具体分析几种无效的建设工程施工合同的类型。第三章是针对无效建设工程施工合同的不同履行状态,分别探讨无效合同的处理。笔者希望通过本文能对公正维护承发包双方的利益和规范建筑市场有所帮助。更多还原

【Abstract】 The architecture industry is the national economy development prop. The architecture Industry word-wide development, which directly affects the national economy health. Our country has established the Construction contract laws and egulationsmanagement system in the construction filed. Our country architecture industry initially established including the Construction Law and the Bid law and Contract Law as the pillars of Quality Management Ordinance. The construction of the basic framework of the legal system is supplemented by the Construction project management of production safety regulations, construction projects, environmental protection regulations, and local laws and regulations, departmental regulations and other regulatory documents.Because of the complex of the construction system, there appeared many new problems especially the problem that how to define a invalid construction contract. The present paper main research invalid construction contract starting with the first part is the features of the construction contract with its clear distinction between the general contract. And the second part according to the judicial interpretations of the construction contract, analysis the different kinds of invalid construction contract .The latter part of the paper focus on discussing the consequences.I hope that the party of the construction contract the construction market can benefit from the paper.更多还原
