【摘要】 霍布斯、斯宾诺莎为有限政府理论的形成奠定了初步的思想基础,在洛克的著作《政府论》中,有限政府理论的核心要素第一次被系统地提炼出来,其中洛克的自然权利理论、社会契约论和分权制衡理论构成了有限政府理论的核心。孟德斯鸠、休谟等人对有限政府理论的发展作出了重大贡献,有限政府理论曾一度衰落,但二战后,这种理论开始复兴,重要的代表人物有哈耶克、布坎南等,重要的代表理论有公共选择理论、政府有限能力理论等。本文在回顾了有限政府理论的发展历程的基础上,研究了有限政府的内涵,包括:政府职能范围被限制在公共领域;政府运行上实行透明行政;权责关系上具有自律性;权力受到公民权利的制约;权力受到制约的法治政府。同时探讨了有限政府的内在要求以及其依据问题。在20世纪以前,强调政府权力“有限”一直是西方宪政理论研究和实践探索的主旋律,但是有限政府的目标应该是追求“有限”与“有为”二者的平衡。基于以上目标,有限政府的构建应通过:宪法具有分权与制衡的设计、独立的司法制度的确立、违宪审查制度的建立、法治的实现、实现政府与社会的良性互动等途径才能得以实现。更多还原

【Abstract】 Content:Hobbes,and Spinoza have laid the preliminary ideological foundation for the formation of the limited government theory,in Locker’s work——"Government Discusses",the core essential factor of the limited government theory is refined systematically first time,Locker’s natural right theory,the social contract theory and the power check and balance theory constitute the core of the limited government theory.Montesquieu,Hume and so on.have made the important contributions to the development of the limited government theory,the limited government theory once declined,but after World WarⅡ,this kind of theory starts to revive,the important representative person has Hayeke,Buchanan and so on,and the important representative theory has the public choice theory,the government limited ability theory and so on.This article that on the base of reviewing the developing process of the limited government theory,has studied the limited government’s connotation that including:The government function scope is limited in the public domain;The government action practices the transparent administration;The power and responsibility relates has the automatic rhythmicity;The authority receives the restriction of the citizens rights,it’s the law government with the authority receiving the restriction.Simultaneously has discussed the limited government’s intrinsic request as well as its evident question. Before the 20th century,stressing the "limited" of the government authority has been the main melody in Western constitutional government theory research and the practice-exploration,but the limited government’s goal should be pursuing the balance between the "limited" and "active".On the base of above goal,the construction of the limited government can be attained through:there are designing with "the power check and balance" in the constitution,the establishment of the independent legal system,the establishment of the violation-constitution reviewing mechanism,the attainment of the law -government,the attainment of the better interaction between the government and society and so on.更多还原
