【摘要】 伴随新型农村合作医疗制度的建立发展,对于传统农村合作医疗制度的研究也随之兴起。但是,相关研究多集中在对合作医疗制度发展进程的事实描述,对其理论制度方面的分析相对缺乏,从法学视角关注其法律属性等问题者更是鲜见。本文通过对我国农村合作医疗制度历史变迁的回顾和评析,笔者认为现行的新型农村合作医疗制度并不是合作社意义上的“合作”,而是一种医疗保险制度。在对农村合作医疗和医疗合作社法律属性进行分析的基础上,提出面对现阶段农村合作医疗制度上的缺陷和实践中的困境,在完善农村合作医疗制度的同时,另行构建公用合作社性质的医疗合作社,建立一套可行的医疗合作社制度,以弥补合作医疗制度的不足。该制度与现行的新型农村合作医疗制度并存并行,在各自“擅长”的领域内发挥积极作用,相辅相成,真正以农村居民为主体,为农民服务,真正实现农民的医疗互助共济,真正解决农民因病致贫、因病返贫的问题。更多还原

【Abstract】 Along with the establishment of new rural cooperative medical treatment system, the traditional rural cooperative medical service system also becomes one of the most remarkable academic focuses. However, the correlative researches mostly concentrate on the factual description of the historical development process of cooperative medical treatment system instead of theoretical and essential analysis, say nothing of its legal attribute in the legal science theory field.Through the review and evaluation of rural medical service system vicissitude in Chinese history, the author concludes that the present new rural cooperative medical treatment system is one kind of medical safeguard or the medical insurance system rather than“cooperation”in the sense of Cooperative. The essay analyzes the law attribute of rural cooperative medical service and suggests that putting the reform and consummation of rural cooperative medical service system aside, a feasible medical cooperative society system should be created by establishment of medical cooperative society for public use, which aims at making up the insufficiency of actual cooperative medical treatment system.The feasible medical cooperative society system will coexist with the present new rural cooperative medical treatment system. They could run in parallel and display positive roles separately in each one’s own domain as well as supplementing each other while serving the countryside inhabitants.
