【摘要】 当今社会,人们对于“文化遗产”一词已不再陌生,遗产地的旅游逐渐走进人们的生活。遗产的保护也引起了越来越多的重视,围绕怎样保护的问题,人们开始从法律、制度、思想、理论、方法、技术等各个角度展开研究。在此基础上,笔者从法律从角度出发,对完善中国文化遗产的立法保护进行分析。首先对文化遗产的概念进行界定,概述本文研究的理论基础;然后总结中国文化遗产立法保护的历史和现状,与国际法的发展历程相对应,在此基础上阐述文化遗产国际法保护的哪些理念和精神是我们要学习的;接着通过事实分析中国目前文化遗产立法和执法存在的问题,讨论应该怎样在立法时从根本上解决这些问题?最后通过对国外文化遗产保护立法的考察,进行立法模式、立法体系及具体规定上的比较分析,总结出一些可供我国借鉴的思想和经验,并由此提出一些建议。更多还原

【Abstract】 Every cultural heritage is the crystallization of human wisdom, which records the history and culture .At this times, cultural heritage is no longer an unfamiliar term to the public, even at the same time ,tours of heritage gradually step into people’s lives. With heritage attracting more and more attention, the issue of how to protect heritage, is being studied from legal, institutional, ideological, theoretical, methodological and technical points of view. On this basis, the author, from a legal point of view, did some analysis of improving the legislation of protection of cultural heritage.For the sake of protection of cultural heritage, international and domestic laws are interactive. On the one hand, a number of European countries with early awareness of cultural heritage, like France, Italy, have got methods and theoretical studies of earlier maturity, and so there is a corresponding content in the law, which greatly promotes the international legal protection of cultural heritage. On the other hand, in the development of the domestic law, State parties, in light of national conditions, follow the principles and concepts of international laws to achieve effective protection of cultural heritage.With theoretical analysis combined with empirical research, this paper studied the cultural heritage ,setting the Marxist world outlook and methodology as the guide, paying attention to the unity of universality and particularity, using historical analysis, legal analysis, comparative analysis , system analysis and so on as research methods.First we defined the concept of cultural heritage, list out an overview of the theoretical basis for this paper, and then summed up the history and status quo of legislation to protect cultural heritage in China. The relative course of development of international law was included also, on the basis of which, we drew the conclusion that which spirits and which concepts of it are that we should learn; then we adopted the factual analysis of problems of the cultural heritage of China’s current legislation and that coming up during law enforcement, to discuss how legislation should be a fundamental solution to these problems. Finally, through investigation of legislation of cultural heritage protection of foreign countries, comparative analysis of the model of legislation, legislative system and the specific provisions, we summed up some ideas and experience desirable to draw on.更多还原
