【摘要】 农民工因为自身的受教育程度和社会地位等原因决定了他们大多从事的是最苦、最累、最危险的工作。他们大多数从事的行业以制造业、建筑业和服务业为主。矿山、建筑、危险化学品、烟花爆竹等高风险行业,大都是农民工密集的行业,也是农民工干得最苦,死伤率最高的行业。2004年1月1日《工伤保险条例》开始在全国实施。改变了过去只有国家行政、事业单位和一些国有企业的职工才能享受工伤待遇的状况,将中小企民营企业和个体工商户全部纳入参保范围,并第一次明确的将农民工涵盖在参保范围内,为农民工工伤保险提供了法律依据。但是《工伤保险条例》在实际的施过程中还是存在着各种漏洞和不完善的地方,致使在建筑业这样人员流动性大的行业推广难度较大,工伤保险没有达到全面覆盖的目的。很多农民工被排在工伤保险的覆盖范围内,无法维护工伤后应得的合法权益。本文通过把广州建筑行业工伤保险的数据和理论结合起来分析广州市建筑工伤保险问题。第一部分为文章的绪论,介绍文章研究的背景、意义以及国内外研究的现状等;第二部分是关于农民工工伤保险理论的研究;第三部分分析了农民工的产生及其原因,总体上概括了农民工的群体特征,同时介绍广州市建筑行业农民工工伤保险现状的分析;第四部分主要分析广州建筑行业农民工的工伤保险问题及产生的原因;第五部分论述国外工伤保险的模式并进行比较,从而为我国工伤保险提供一些启示;第六部分提出了解决农民工工伤保险问题的政策建议,主要包括户完善意外伤害险和相关法律制度,建立科学有效的工伤保险费率机制和农民工工伤保险基金等。更多还原

【Abstract】 Peasantry workers, limiting by their education background and social class, are always engaged in hardest, most tired and dangerous jobs. Most of them are engaged in industries like manufacturing, construction and services. Industries like mining, construction, hazardous chemicals, Catharine and firecracker industry and so on own largest number of peasantry workers. Theses industries are also with hardest work and highest injuries and deaths rate. On Jan 1st, Injury Insurance Act is being put into practice over the whole nation. This changes the situation that only staffs of national administration, public institution and some workers in state-owned enterprises can enjoy injury insurance formerly. The act brings all middle and mini-sized enterprises, private enterprises and individual owned business into the scope of the injury insurance. The act firstly brings peasantry workers into the scope of injury insurance distinctly and forms a legal base of injury insurance for peasantry workers. However, this act still has disadvantages when it is being practiced. This makes it difficult to being promoted in industries like construction in which the fluidity of labors is quite high. The injury insurance has not reached full coverage. Many peasantry workers are neither included in the scope of the injury insurance nor enjoy the legal rights and interests after they are hurt at work.This thesis analyzes injury insurance problems of peasant workers by combining the relative data method with theory. The first part mainly introduces the background and the significance and the research about home and aboard the article. The second part introduces the theoretical research of the peasant workers injury insurance. The third part analyzes the emergence of the peasant workers and the reasons of emergence, and summarizes their characteristics. Analyze the current situation of injury insurance problems for the peasant workers of Guangzhou city. The fourth part mainly analyzes the problem of injury insurance problems for peasant workers in Guang Zhou city. The fifth part mainly analyzes the model of injury insurance and compare the difference and provide some message of our country injury insurance. The sixth part is the main part of this text and it put forward the policy suggestions on injury insurance problems for peasant workers. Mainly conclude complete injury insurance and relative laws, set up scientific and effective mechanism of injury insurance and building industry fund of injury insurance etc.更多还原
