【摘要】 随着世界各国行刑社会化的不断发展,社区矫正制度在西方主要发达国家和我国港台地区已经成为一种主要刑罚执行方式。顺应这一趋势,中国大陆目前己有18个省、市、自治区开展了社区矫正的试点。由于这一制度毕竟在我国刚刚起步,无论在理论上还是实践中都没有形成一套成熟的模式,因此试点中不可避免地出现了一些问题,其中最突出的就是矫正对象正当资源和权利的被剥夺而导致他们处于一种“失权”的状态,并且这种“失权”在一定程度成为了矫正工作深入开展的障碍。针对这种情况,本文在借鉴英、美等发达国家矫正工作经验的基础上,明确提出了我国目前青少年罪犯社区矫正制度的发展完善途径,即将社会工作的价值理念和方法应用于社区矫正,实现两者的有机结合。笔者从社会工作的“增权”理论入手,结合社会学、犯罪学等相关知识,依据上海、江苏等地的实践经验,运用文献法和实证调查综合分析法,对“社会工作如何介入青少年罪犯的社区矫正”这一课题进行探讨。文章在探讨我国青少年罪犯社区矫正制度不足的基础上,打破传统的矫正观念,提出了一系列带有科学、前卫精神的矫正措施、方法和对策。强调运用社会工作的理念与方法并对它们进行本土化改造;矫正工作者从矫正对象自身的认知、情绪问题、人际关系等方面存在的不足和缺陷入手;运用小组、个案、社区三大专业工作方法,调动社会资源,打开存在于矫正对象自身人格中的力量之源,积极地从外部推动矫正对象的增权,进而恢复其社会功能。更多还原

【Abstract】 With the development of the socialization of criminal execution in the world, community-based correction has become a major manner for criminal punishment in developed countries, Hong Kong and Taiwan in China. Comply with this tendency, our country has now had 18 province and city,autonomous region have developed community-based correction. As a new justice social work field, the community-based correction is still at the initial stage in China, so there isn’t a developed mode not only in practice but in theory. Some questions are caused during the practice, among them the most outstanding one is the dispowerment of the recourses and rights of the juvenile offenders. And the dispowerment has become the obstacle of its movement.So this paper put forward the development way definitely about the community-based correction , by learning the experience of western countries such as America, England. That is using the principles and methods of social work to bring freshment to the community-based correction at the moment. The writer will make use of the social work theory——“empowerment”to inquiry into this problem, with the guidance of sociology, law etc, discussing on the question“the involvement of social work to the community correction of the juvenile criminal”, on the basis of the investigation of some experimental projects in Shanghai, and Jiangsu, using the methods of literature law and empirical investigation.This paper break the traditional view of rectification on the deficiency of community-based correction. It proposes a series of scientific progressive policies and measures. That is on the foundation of localization transforms to social work’s ideas and methods, the social workers should take up from the criminals’cognitive dissonance, emotional disorder and interpersonal relationship shortage, using of local social and cultural resources and professional methods, such as case work, group work and community work to the resolve of the problem of“dispowerment”from external environment to resume criminals’social function.更多还原
